f <br /> .. <br /> .. , <br /> � ^ <br /> COUNCIL MEMORANDUM <br /> #2005-03 <br /> DATE: May 11, 2005 <br /> TO: Honorable Mayor Osborne and City Council <br /> FROM: Steve City Manager <br /> SUBJECT: Taxicab License Hearing Officer <br /> SUlVIlVIARY RECO�NDATION: Staff recommends approval of the proposed <br /> resolution appointing the City Manager or his designee as the hearing officer for all new <br /> taacicab license applications. <br /> BAC`KGROUND: Because new taacicab applications are, in fact, rare, there has never <br /> been a clear-cut definition of who should be responsible for holding the required public <br /> hearings on such applications and for reporting findings to the City Council. This, in turn, <br /> can create problems for applicants because of the timing of council meetings where such <br /> an appointment would have to take place and can significantly delay the application <br /> process (hearing must be scheduled, notice must be given in advance of the hearing to a11 <br /> city taxi owners, etc.) <br /> The proposed resolution would name the City Manager or his designee as the <br /> person responsible for carrying out the application process as is spelled out in Chapter 60 <br /> of the City Code when a license is requested and for reporting those findings to the <br /> Council. The Council, however,would still have the ultimate resaonsibilitv of voting <br /> to aaprove or denv the aoplication based on renorted inaut from the hearings and <br /> other desired research. <br /> POTENTIAL OBJECTIONS: None, as this is not a vote on the actual license,just the <br /> appointment of a heazing officer. <br /> STAFF REFERENCE: Wendy Morthland, Corporation Counsel at 424-2807 <br /> BUDGET/TIlVIE IlVIPLICATIONS: We currently have an applicant for a new license. <br />
