AMENDMENT NO. 1 AGREEMENT FOR DESIGN SERVICES FOR SOUTH ELEVATED WATER STORAGE TANK Whereas,the CITY OF DECATUR,hereinafter referred to as the"OWNER"and BAINBRIDGE, GEE, MILANSKI & ASSOCIATES, INC., hereinafter referred to as the "ENGINEER", entered into an Agreement for engineering services dated April 2, 2001, hereinafter referred to as the "ORIGINAL AGREEMENT," and Whereas the scope of the ORIGINAL AGREEMENT was for a proj ect which would not be funded through the Illinois Environmental Protection Agency's State Revolving Loan program, and Whereas it is now the desire of the OWNER to fund the project with a loan from the State Revolving Loan program, and Whereas the State Revolving Loan program guidelines require certain provisions to be included in the design engineering contract, Whereas the scope of work involved with selecting the water tower site has changed,the EPA loan funding requirements have been added, and the original contract amount was based on the ENGINEER'S 2001 fee schedule, NOW THEREFORE, the ORIGINAL AGREEMENT is hereby amended as follows: l. Add paragraph l.j. of page 1 to read as follows: "It is understood that this project will be funded with an IEPA Loan. The Contract and the construction documents will be prepared following the required guidelines of the IEPA Loan program." 2. Add the following paragraphs 3 and 4 under THE ENGINEER AGREES: 3. Project Required Provisions a. The ENGINEER agrees to take affirmative steps to assure that small, minority, and women's business enterprises are utilized when possible as sources of supplies, equipment, construction, and services and to provide evidence that such steps were taken in accordance with Part 35.3145(d).
