� � ti Y , � <br /> PROGRAMMATIC AGREEMENT <br /> BETWEEN THE CITY OF DECATUR ' <br /> AND THE ILLINOIS STATE HISTORIC PRESERVATION OFFICER <br /> FOR CERTAIN PROGRAMS OF THE <br /> U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT � <br /> ADMINISTERED BY THE CITY OF DECATUR � <br /> WHEREAS, the City of Decatur, Illinois (City)has determined that the implementation of its , <br /> Community Development Block Grant(CDBG) and other U.S. Department of � <br /> Housing and Urban Development(HLTD)programs for Federal Fiscal Years <br /> 2002—2014(listed in Appendix A)may have an effect on properties included or <br /> eligible for inclusion in the National Register of Historic Places; and <br /> WHEREAS, these programs aze administered by the City's Neighborhood Redevelopment <br /> Division(Division)and encompass a variety of activities including <br /> rehabilitation,new construction, demolition, and infrastructure improvements, <br /> etc.; and <br /> WHEREAS, the City has consulted with the Illinois State Historic Preservation Officer <br /> SHPO)pursuant to Section 106 of the National Historic Preservation Act on <br /> 1966,as amended(16 U.S.C. 47 0�and its implementing regulations, "Protection <br /> of Historic and Cultural Properties"(36 CFR Part 800); and <br /> WHEREAS, the City and the SHPO have determined that the City can more effectively fulfill <br /> its Section 106 review responsibilities for CDBG, HUD and IHDA program <br /> activities if a programmatic approach is used to delegate Section 106 compliance <br /> responsibilities to the City; and <br /> WHEREAS, the City is a Certified Local Government with a historic preservation review <br /> commission and qualified professional staff who will carry out duties enumerated <br /> below. <br /> NOW, THEREFORE,the City the SHPO,and the Council agree that the programs shall be <br /> implemented in accordance with the following stipulations in order to take into <br /> account the effect of the undertaking on historic properties. <br /> STIPULATIONS <br /> I. Qualified Personnel <br /> A. The City shall ensure that it maintains a staff that meets the qualifications outlined <br /> in 36 CFR Part 61,the Secretary of the Interior's Professional Qualification <br /> Standards,hereafter refened to as Certified Staff. <br /> 1 <br />
