H. R@p01'tln9/C011SUIt8tlOn. GOVERNMENTAL BODY shall consult with and keep the DEPARTnnENT fully informed as to the progress of all matters covered by this Agreement. I. Travel Expenses. No expenses for travel, lodging, or per diem shall be paid by the DEPaRTnnE►vT pursuant to this Agreement. J. Indemnification. Unless prohibited by State law, the GOVERNMENTAL BODY agrees to hold harmless and indemnify the DEPARTMENT, and its officials, employees, and agents, from any and all losses, expenses, damages (including loss of use), suits, demands and claims, and shall defend any suit or action, whether at law or in equity, based on any alleged injury or damage of any type arising from the actions or inactions of the GOVERNMENTAL BODY and/or the GOVERNMENTAL BODY'S employees, officials, agents, contractors and subcontractors, and shall pay all damages, judgments, costs, expenses, and fees, including attorney's fees, incurred by the DEPARTMENT and its officials, employees and agents in connection therewith. K. Equal Employment Opportunities, Affirmative Action, Sexual Harassment. The GOVERNMENTAL BODY will comply with the Illinois Human Rights Act with respect to public contracts, including equal employment opportunity, refraining from unlawful discrimination and having a written sexual harassment policy. PART 5 SCOPE OF SERVICE/RESPONSIBILITIES The GOVERNMENTAL BODY will provide the work described in the approved FY 2005 Unified Work Program (UWP). Those activities in which the Department will participate with Federal Metropolitan Planning (PL)funds and Federal Transit Administration (FTA) Section 5303 funds are shown in the following UWP work elements. � 102 Coordination & Information: Governmental Body will administer all aspects of the Decatur Public Transit System (DPTS) including public meetings, news releases, staff coordination, documentation and certification. 103 Transportation Support: Governmental Body will administer in a timely manner all aspects of transit planning contracts, including preparation of funding applications,financial and program status reports and invoices. 106 Unified Transportation Planning Work Program (UTPWP): Governmental Body will develop the annual planning work program (the FY 2005 UTPWP) that addresses multi- model transportation issues/problems. � 201 Data Collection &Analysis: Governmental Body will collect and analyze socio-economic information and information on various transportation modes and systems in the Decatur Urbanized Area, and to maintain current assessment of transit ridership, revenues and expenditures, and routes and service. 501 Transportation Improvement Program (TIP): Governmental Body will maintain an updated three-year, multi-modal TIP, the FY 2006—FY 2008 Transportation Improvement Program including capital and operating expenses. 502 Transportation Systems Management: Governmental Body will review and analyze transit management including: 1. DPTS performance standards. 2. DPTS performance relative to other transit systems. 3. On/Off board transit passenger surveys to assist with designing more efficient routes and schedules.
