H. R@p01'tln9/C011SUIt8tlOn. GOVERNMENTAL BODY shall consult with and keep the <br /> DEPARTnnENT fully informed as to the progress of all matters covered by this Agreement. <br /> I. Travel Expenses. No expenses for travel, lodging, or per diem shall be paid by the <br /> DEPaRTnnE►vT pursuant to this Agreement. <br /> J. Indemnification. Unless prohibited by State law, the GOVERNMENTAL BODY agrees to <br /> hold harmless and indemnify the DEPARTMENT, and its officials, employees, and agents, from any <br /> and all losses, expenses, damages (including loss of use), suits, demands and claims, and shall <br /> defend any suit or action, whether at law or in equity, based on any alleged injury or damage of any <br /> type arising from the actions or inactions of the GOVERNMENTAL BODY and/or the <br /> GOVERNMENTAL BODY'S employees, officials, agents, contractors and subcontractors, and shall <br /> pay all damages, judgments, costs, expenses, and fees, including attorney's fees, incurred by the <br /> DEPARTMENT and its officials, employees and agents in connection therewith. <br /> K. Equal Employment Opportunities, Affirmative Action, Sexual Harassment. The <br /> GOVERNMENTAL BODY will comply with the Illinois Human Rights Act with respect to public <br /> contracts, including equal employment opportunity, refraining from unlawful discrimination and <br /> having a written sexual harassment policy. <br /> PART 5 <br /> SCOPE OF SERVICE/RESPONSIBILITIES <br /> The GOVERNMENTAL BODY will provide the work described in the approved FY 2005 Unified <br /> Work Program (UWP). Those activities in which the Department will participate with Federal <br /> Metropolitan Planning (PL)funds and Federal Transit Administration (FTA) Section 5303 funds are <br /> shown in the following UWP work elements. � <br /> 102 Coordination & Information: Governmental Body will administer all aspects of the Decatur <br /> Public Transit System (DPTS) including public meetings, news releases, staff <br /> coordination, documentation and certification. <br /> 103 Transportation Support: Governmental Body will administer in a timely manner all aspects <br /> of transit planning contracts, including preparation of funding applications,financial and <br /> program status reports and invoices. <br /> 106 Unified Transportation Planning Work Program (UTPWP): Governmental Body will <br /> develop the annual planning work program (the FY 2005 UTPWP) that addresses multi- <br /> model transportation issues/problems. <br /> � 201 Data Collection &Analysis: Governmental Body will collect and analyze socio-economic <br /> information and information on various transportation modes and systems in the Decatur <br /> Urbanized Area, and to maintain current assessment of transit ridership, revenues and <br /> expenditures, and routes and service. <br /> 501 Transportation Improvement Program (TIP): Governmental Body will maintain an updated <br /> three-year, multi-modal TIP, the FY 2006—FY 2008 Transportation Improvement Program <br /> including capital and operating expenses. <br /> 502 Transportation Systems Management: Governmental Body will review and analyze transit <br /> management including: <br /> 1. DPTS performance standards. <br /> 2. DPTS performance relative to other transit systems. <br /> 3. On/Off board transit passenger surveys to assist with designing more <br /> efficient routes and schedules. <br /> Intergovernmental Agreement(Rev.03/04) 10 Decatur FTA-05 <br />
