.. � i � � <br /> AGREEMENT <br /> WHEREAS, the Town of Long Creek ("Town") owns and operates a water works <br /> system; and, <br /> WHEREAS, the City of Decatur, Illinois, ("City") owns and operates a water works <br /> system; and, <br /> WHEREAS, both parties desire to enter into an agreement to secure a supply of treated <br /> water from the system of the City for the syst�m of the Town during ep+sodes occasir�ned by a <br /> temporary failure of the Town's water works system or some part thereof, and to define the <br /> adjacent water service boundaries of both parties. <br /> For and in consideration of the promises and covenants respectively to be performed by <br /> the parties hereto, it is agreed by and between the Town of Long Creek, and the City of <br /> Decatur, Illinois, as follows: <br /> 1. That the term of this agreement will be for a period of five (5) years commencing <br /> June 1, 2004. <br /> 2. (a) That during the term of this Agreement, the Town may extend its water <br /> distribution system into the following areas: <br /> (i) That portion of Oakley Township lying east of the line described on <br /> Exhibit A hereto (the "boundary line"); <br /> (ii) That portion of Mt. Zion Township lying outside of the area bounded by <br /> said boundary line; and, <br /> (iii) That portion of Long Creek Township lying south and east of said <br /> boundary line. <br /> The Town may continue its water distribution system in that portion of South Wheatland <br /> Township lying in that area bounded by said boundary line.
