In the event that such attachments <br /> become defective, Licensor shall have the right, upon prior written notice to Licensee, to require <br /> Licensee to immediately repair such defective condition(s) and if, upon the expiration of thirty <br /> (30) days after giving of such notice, Licensee shall have failed or refused to make such repairs, <br /> Licensor shall have the right to remove such attachments from its pole(s) and shall not be liable <br /> to Licensee in any manner on account thereof. <br /> 8. Licensee, its successors and assigns shall indemnify,protect, defend and save <br /> harmless Licensor, its successors and assigns from and against any and all claims and demands <br /> for damages to property and injury or death to persons other than Licensor's employees, <br /> including attorneys' fees, expenses and costs, payments made under any workers' compensation <br /> law or under any plan for employees' disability and death benefits (including, without limitation, <br /> claims and demands which may be asserted by employees, agents, contractors and subcontractors <br /> of Licensor) which may arise out of, or be caused by, (i) the contact of Licensor's equipment <br /> with that of Licensee, even where such contact is alleged or proven to have been caused in whole <br /> or in part by any act(s) or omission(s) of Licensor or its employees, (ii) the erection, <br /> 3 <br />
