a) The Company should install new automatic flashing light signals and gates <br /> controlled by the appropriate circuitry. <br /> b) The Company should remove and replace the deteriorating asphalt transition <br /> strips adjacent to the crossing rubber crossing surface, and remove and <br /> replace the deteriorating asphalt on the east pedestrian crossing in order to <br /> comply with requirements of 92 Illinois Administrative Code Part 1535.203. <br /> c) The removal of trees and brush on Company right of way for a distance of <br /> 500 feet on the northeast and northwest quadrants of the subject railroad <br /> crossing in order to comply with 92 Illinois Administrative Code, Part <br /> 1535.205. <br /> d) The Company should install temporary STOP signs (if ordered) at the <br /> Woodford Street crossing within 30 days of receipt of a Commission Order for <br /> the installation of new automatic warning devices. <br /> e) The City should re-install the highway-rail grade crossing pavement mar�icings <br /> on the north and south approaches in order to comply with requirements of <br /> 92 Illinois Administrative Code Part 1535.310. <br /> Section 3 The Company has prepared preliminary "round figure" estimates of cost to <br /> accomplish the proposed warning device improvements, which it may be required to <br /> perform. Said estimates are attached as Exhibit B The Company shall, upon Order, <br /> according to the requirements contained therein, prepare detailed drawings, detailed <br /> circuit plans, estimates of cost and any required specifications for the proposed <br /> improvements for the approval of the Commission and Department. <br /> Section 4 The Company shall upon Order, according to the requirements contained <br /> therein, proceed toward the completion of the proposed improvement, accomplishing the <br /> work with its own forces or appropriate contracted services and agrees that an <br /> appropriate time for the completion of the proposed improvement should be twelve (12) <br /> months, from the date of Commission Order subsequent to this agreement. <br /> Section 5 The parties hereto agree that an equitable division of cost for the proposed <br /> improvement should be: <br /> a) The cost to perForm the work outlined in Section 2(a) is estimated at <br /> $155,600. The Grade Crossing Protection Fund (Fund) should pay <br /> 85% of the actual project cost, not to exceed $132,260. The City <br /> should pay 10% of the actual project cost, not to exceed $15,560. The <br /> Company should pay all remaining installation costs as well as all <br /> future operating and maintenance costs. <br /> b) The Company should pay 100% of the costs to repair and maintain the <br /> crossing surfaces, to remove and maintain the trees and brush on their <br /> right-of-way, and the cost to install (if ordered) and maintain temporary <br /> STOP signs at the subject crossing, as stated in Section 2 (b), (c), and <br /> (d) above. <br /> c) The City should pay 100% of the cost to re-install the highway-rail <br /> grade crossing pavement markings on the north and south <br /> 2 <br />
