SAMPLE AGREEMENT <br /> NEIGHBORHOOD STABALIZATION PROGRAM <br /> CONSTRUCTION CONTRACT <br /> This Lead Hazard Mitigation/Abatement Construction Contract (the"Contract") made as of this <br /> day of , 2003, by and between Harold& Alice Wathan (the"Owner") and, <br /> _ (the "Contractor"); <br /> WITNESSET�I: <br /> WHEREAS, the Owner is the owner of a residentiaUmulti-familystructure located at <br /> Building#1: 1113 North Main Street 1115 North Main Street and 1115 1/2 North Main Street; <br /> Building#2: 1102 North Main Street 1102 1/2 North Main Street 1105 North Main Street and <br /> 1107 North Main Street; <br /> Building#3: 114 West Packard St. 116 W. Packard St 118 W Packard St and 118 %z W <br /> Packard St.; and <br /> Building#4: 134 West Packard St. 136 West Packard St and 136 %2 West Packard Decatur, <br /> Illinois (the"Propert�'); and <br /> WHEREAS, the Owner wishes to mitigate/abate the lead-based paint hazards present at <br /> the Property(the "Project") and participate in the residentiaUmulti-family rehabilitation program <br /> with financing provided by the City of Decatur, a unit of local government (the"Sponsor") <br /> funded by a grant from the U.S. Department of Housing and Urban Development; and <br /> WHEREAS, the Owner and the Contractor recognize that the receipt and use of HUD <br /> Program funds obligates them to comply with all Federal, State and local laws, ordinances, rules, <br /> regulations, circulars, and executive orders applicable to the Project. <br /> In consideration of the recitals set forth above and other good and valuable consideration, <br /> the receipt of which is hereby acknowledged, the parties agree as follows: <br /> 1. Recitals. The recitals set forth above are incorporated herein by this reference. <br /> 2. Contract. This Contract shall consist of the Contract and the description of the scope of <br /> work attached hereto as Exhibit A and made a part hereof(the"Scope of Work"). The <br /> Contractor agrees to perform, or cause to be performed, all of the services and to supply <br /> all of the materials necessary to make the improvements and repairs described in the <br /> Scope of Work in order to complete the Project(the"Work"). <br /> 3. Employment of Contractor. The Owner agrees to employ the Contractor to perform the <br /> services and to supply the materials described in this Contract. <br /> 4. Sponsor's Role. In addition to financing, the Sponsor shall provide technical assistance <br /> in the form of oversight and approval of work performed to ensure compliance with all <br /> Page 1 of 22 <br />
