� <br /> Secretary of HUD) in which the Property is located; and (ii) contracts in connection <br /> with the Work shall be awarded to business concerns engaged in the business of <br /> construction that are located in, or owned in substantial part by,persons residing in <br /> the same unit of local government, metropolitan area or non-metropolitan county as the <br /> Property. <br /> d. The Contractor shall use its best efforts to use minority and women's business <br /> enterprises for any Work subcontracted in connection with the Project, as provided in <br /> Executive Orders 11625, 12432 and 12138. <br /> 15. Assignment. This Contract shall not be assigned to another contractor without the prior <br /> written approval of the Owner and the Sponsor,which approval shall not be unreasonably <br /> withheld. Any approved assignment shall be made subject to all the provisions of this <br /> Contract. <br /> 16. Conduct of Work. <br /> a. All Work performed by the Contractor and any subcontractors shall be performed <br /> in a workmanlike manner to the reasonable satisfaction of the Owner and the Sponsor. <br /> All Work shall be performed by mechanics skilled in their respective trades in accordance <br /> with the best practices of such trades, and the Contractor or subcontractors shall not <br /> employ any person to perform any portion of the Work who is unfit or without <br /> sufficient skills to perform the job for which such persons are employed. If the Work <br /> fails to meet these standards, the Contractar shall have the Work redone at the <br /> Contractor's expense. Furthermore, the Contractor shall maintain strict discipline on the � <br /> Property or the Work site at all times. I <br /> b. The Contractor and any and all subcontractors shall keep the premises clean and I <br /> orderly during the course of the Project. The Contractor and all subcontractors shall ! <br /> remove all rubbish,refuse, debris, garbage, or litter from the Property at the end of each � <br /> work day, or place it in an appropriate and secured container for disposal. The Contractor <br /> shall also remove all equipment and unused materials from the property and street <br /> immediately at the completion of the Project. All removals required by this subparagraph <br /> shall be at the Contractor's expense. The unused materials shall belong to the Contractor, <br /> unless paid for by the Owner or otherwise stipulated to by the Owner and the Contractor <br /> in writing. <br /> c. The Contractor shall be solely responsible for all construction under this Contract, <br /> including the techniques, sequences,procedures,means and coordination of all Work; for <br /> the proper fitting of all materials; for the condition of the operations of all trades, <br /> subcontractors or material suppliers engaged in connection with the Project; and that all <br /> work performed and materials used are in accordance with the U.S. Department of <br /> Housing and Urban Development's Guidelines for the Evaluation and Control of Lead- <br /> Based Paint Hazards in Housing," and the National Institute of Building Sciences' <br /> "Guide Specifications for Reducing Lead-Based Paint Hazards." The Contractor shall <br /> provide to each subcontractor, and shall guarantee the accuracy of, the locations and <br /> measurements that they may require for the proper fitting of their portion of the Work to <br /> Page 6 of 22 <br />� <br />
