g. To submit the report in the form of a Project Plan, in sufficient detail, to be used <br /> in the application for an IEPA revolving loan. <br /> h. To submit the report to the appropriate agencies for Project Plan approval. <br /> i. To work with and identify for a Title Company the properties needed for <br /> temporary and permanent easements. <br /> j. To answer questions and discuss route alternatives with a Right of Way Agent, <br /> hired by the Owner. <br /> k. To submit five copies to the OWNER, of the report summarizing the findings and <br /> recommendations of the study, including exhibits showing the alternatives, the <br /> comparison of alternatives and the estimates of costs. <br /> 2. Time of Performance— Within 120 calendar days from receipt of a "Notice to Proceed" <br /> from the OWNER, the ENGINEER shall submit the Project Plan and associated <br /> documents to IEPA for approval. It is understood that the review time required by IEPA <br /> is not within the control of the OWNER or the ENGINEER. Additional information <br /> requested from the ENGINEER by IEPA will be submitted in a timely manner. The <br /> ENGINEER will meet with the Owner within 45 days from the Notice to Proceed to <br /> present the alternate routes and costs for the Owner's review. <br /> 3. Standard of Care - That they have the skills and expertise, and the necessary trained <br /> personnel available for the performance of the duties for which it is hired, and it agrees <br /> that in the event of a dispute with the OWNER, the ENGINEER's performance of all <br /> duties under the AGREEMENT shall be judged by a standard of care and skill ordinarily <br /> exercised by members of the same profession cunently practicing under similar <br /> circumstances. <br /> 4. Insurance—The ENGINEER shall procure and maintain for the term of this Contract, at <br /> its expense, insurance of the type in the minimum amounts stated below: <br /> a. Workers' Compensation Statutory <br /> b. Employer's Liability- <br /> 1.) Each Accident $ 500,000 <br /> 2.) Disease, Policy Limit 500,000 <br /> 3.) Disease, Each Employee 500,000 <br /> c. General Liability- <br /> 1.) Each Occurrence(Bodily Injury&Property Damage) $ 1,000,000 <br /> BGM 03-091 Page 2 <br />
