Any delays in completion beyond the approved schedule <br /> may result in a suspension or termination of funding as outlined in V.(G). <br /> D. CloseoutlFinal Payment <br /> The City reserves the right to withhold up to the final ten percent (10%) of total <br /> reimbursement on each housing unit until all closeout documentation is received. <br /> Closeout documentation shall consist of: final payout requests, final property inspection <br /> sheets and certificate of occupancy, a completed property resale information form, and a <br /> copy of the contract between East Lake and the home buyer including appropriate lien <br /> restrictions or resale provisions for the applicable affordability period. <br /> E. Affordability Req�}irements <br /> To ensure affordability, East Lake must impose either resale or recapture requirements on <br /> each housing unit as outlined in 24 CFR 92.254 (a)(5). Said requirements shall be <br /> imposed prior to the transfer of the property to the homebuyer. East Lake shall inform <br /> the City at that time as to which requirement (resale or recapture)has been imposed, and <br /> shall provide the City with a copy of the lien/deed restrictions attached to the transaction. <br /> F. Property Standards <br /> East Lake shall ensure that all housing it constructs with HOME funds meets all <br /> applicable local codes,H[JD Housing Quality Standards (HQS), ordinances, and zoning <br /> ordinances at the time of proj ect completion. East Lake shall comply with the standards <br /> set forth by the City of Decatur for new construction and with the current edition of the <br /> Model Energy Code. Payout requests for work requiring mechanical, electrical, or <br /> plumbing inspections shall not be processed without documentation that the applicable <br /> permits have been received and required inspections conducted. <br /> G. Ternunation of Funding <br /> The City reserves the right to suspend or ternunate payout of payment requests on a <br /> housing unit in whole or in part for cause. Cause shall include the following: <br /> 1. Improper use of funds; <br /> 2. Failure to comply with the terms and conditions of this Agreement as they <br /> relate to that housing unit, and specifically items A. Through F. above; <br /> 3.Failure to comply with H[ID program guidelines. <br /> The City shall notify East Lake before any such termination takes place and allow <br /> adequate and reasonable opportunity for review and correction of problems. <br /> VI. TECHIVICAL ASSISTANCE <br /> The City shall provide technical assistance to East Lake upon request, at no additional <br /> cost, to guide the organization in the proper administration of the HOME funds. <br /> 4 __ <br />
