VII. NONDISCRIMINATION AND EQUAL ACCESS <br /> A. Affirmative Marketing <br /> East Lake will develop and adhere to an Affirmative Marketing plan for its projects. This <br /> shall consist of actions to provide information and otherwise attract eligible persons in <br /> the housing market area to the project without regard to race, color, national origin, sex, <br /> religion, familial status or disability. The Affirmative Marketing plan shall be submitted <br /> to the City prior to the payout of any payment requests under this Agreement. <br /> B. Fair Housing and Equal Opportunity <br /> East Lake agrees to comply with any applicable City and State Civil Rights ordinances <br /> and with Title VI of the Civil Rights Act of 1964 as amended, Title VIII of the Civil <br /> Rights Act of 1968 as amended, Section 109 of Title I of the Housing and Community <br /> Development Act of 1974, Section 504 of the Rehabilitation Act of 1973,the Americans <br /> with Disabilities Act of 1990,the Age Discrimination Act of 1975, Executive Order <br /> 11063, Executive Order 11246 as amended by Executive Orders 11375 and 12086, and <br /> with the Fair Housing Act(42 U.S.C. 3601-19). <br /> C. Nondiscrimination <br /> East Lake will not discriminate against any employee or applicant for employment <br /> because of race, color, creed,religion, ancestry,national origin, sex, disability or other <br /> handicap, age, marital status, or status with regard to public assistance. East Lake will <br /> take affirmative action to insure that all employment practices are free from such <br /> discrimination. Such employment practices include but are not limited to the following: <br /> hiring,upgrading, demotion, transfer,recruitment or recruitment advertising, layoff, <br /> termination,rates of pay or other forms of compensation, and selection for training, <br /> including apprenticeship. East Lake agrees to post in conspicuous places, available to <br /> employees and applicants for employment,notices to be provided by the conixacting <br /> agency setting forth the provisions of this nondiscrimination clause. <br /> VIII. EMPLOYMENT AND CONTRACTING <br /> A. Independent Contractor <br /> Nothing contained in this agreement is intended to, or shall be construed in any manner, <br /> as creating or establishing the relationship of employer/employee between the parties. <br /> East Lake shall at all times remain an independent contractor with respect to the services <br /> to be performed under this Agreement. The City shall be exempt from payment of all <br /> unemployment compensation,FICA, retirement, life and/or medical insurance and <br /> workers' compensation insurance as East Lake is an independent contractor. <br /> B. Notifications <br /> East Lake will make available to all employees and/or will post in a conspicuous place, <br /> East Lake's commitments hereunder noted. <br /> 5 -- <br />
