C. EqualOpportunity <br /> East Lake agrees to comply with the following regulations that ensure equal opportunity <br /> in employment and contracting: the Equal Employment Opportunity Act, executive order <br /> 11246 as amended; Section 3 of the Housing and Urban Development Act of 1968; and <br /> Executive Orders 1625, 12432, and 12138 regarding minority/women's business <br /> enterprise. <br /> D. Employment Restrictions <br /> East Lake is prohibited from using funds provided herein or personnel employed in the <br /> administration of the program for political activities; sectarian, or religious activities; <br /> lobbying,political patronage, and nepotism activities. <br /> E. OSHA <br /> Where employees are engaged in activities not covered under the Occupational Safety <br /> and Health Act of 1970, they shall not be required or permitted to work,be trained, or <br /> receive services in buildings or surroundings or under working conditions which are <br /> unsanitary, hazazdous or dangerous to the participant's health or safety. <br /> F. Labor Standards <br /> East Lake agrees to comply with the requirements of the Secretary of Labor in <br /> accordance with the Davis-Bacon Act as amended, the provisions of Contract Work <br /> Hours and Safety Standards Act, as amended(40 USC 327-333), the Copeland "Anti- <br /> Kickback" Act(40 U.S.C. 276, 327-333),the Fair Labor Standards Act of 1938, as <br /> amended(29 USC 201, et. seq.), and all other applicable federal, state and locallaws and <br /> regulations pertaining to labor standards insofar as those acts apply to the performance of <br /> this contract. East Lake shall maintain documentation which demonstrates compliance <br /> with hour and wage requirements of this part. Such documentation shall be made <br /> available to the City for review upon request. <br /> G. Subcontracts � <br /> East Lake shall undertake to insure that all subcontracts let in the performance of this <br /> Agreement shall be awarded on a fair and open competition basis. East Lake shall cause <br /> all applicable provisions of this contract in its entirety to be included in and made a part <br /> of any subcontract executed in the performance of this Agreement, and will include the <br /> Section 3 clause in every subcontract. East Lake will take appropriate action pursuant to <br /> the subcontract upon a finding that the subcontractor is in violation of regulations issued <br /> by the Grantor Agency. East Lake will not subcontract with any contractor where it has <br /> notice or knowledge that the latter has been found in violation of regulations under 24 <br /> CFR 85.35 and will not let subcontract unless the subcontractor has first provided it with <br /> a preliminary statement of ability to comply with the requirements of these regulations. <br /> East Lake will not engage the services of any contractor during any period of debannent, <br /> suspension, or placement of ineligibility status. <br /> 6 - <br />
