AGREEVIErT <br /> THIS AGREEMENT, made this 3�d day of November, 2003 between James E. Williams <br /> and Emmy L. Williams (hereinafter refened to as "Contract Seller"), LUCAS Properties, <br /> LLC (hereinafter referred to as "Contract Buyer"), and the CITY OF DECATUR, <br /> ILLINOIS, a municipal Corporation (hereinafter referred to as "City"), <br /> WITNESSETH: <br /> WHEREAS, the City of Decatur has designated an area of architectural and historical <br /> si�ificance, in the central business district, <br /> WHEREAS, the Contract Seller is the owner of improved real estate within the eligible <br /> program area, commonly known as 135 East Prairie Avenue, Decatur, Illinois and legally <br /> described as follows: <br /> Lot One (1) of the Resurvey of Lots One (1), Two (2), Three (3), Four (4) and Eight (8) <br /> of Block Two (2) of the Original Town of Decatur, as per Plat recorded in Book A, Page <br /> 1 of the Records in the Recorder's Office of Macon County, Illinois. Situated in Macon <br /> County, Illinois. (hereinafter referred to as the "propert}�'), and <br /> WHEREAS, the property was destroyed by fire and the structure requires extensive <br /> rehabilitation, <br /> WHEREAS, the City, Contract Seller, and Contract Buyer desire to restore, maintain and <br /> preserve the exterior desi� of the building and accordingly the City has entered into a <br /> redevelopment a�eement with the Contract Buyer, effective October 7, 2002, to <br /> rehabilitate the property for residential and commercial use, and <br /> WHEREAS, the City has previously entered into exterior fa�ade preservation agreements <br /> in current effect regarding the property. <br /> NOW, THEREFORE, in consideration of the sums of money to be reimbursed by the <br /> City for the restoration of the exterior fa�ade of the building on the property, the <br /> beautification and preservation of the property and the covenants made by the Contract <br /> Seller and Contract Buyer herein, the parties agree: <br /> 1. This agreement shall supersede all prior fa�ade agreements in effect joverning the <br /> exterior building features of the property. <br /> 2. Contract Buyer shall perform the renovation work to the building described in the <br /> plans attached hereto and marked "Exhibit A." <br /> 3. The City's liability hereunder for all such renovation work, including all <br /> professional fees, shall not exceed the reimbursable eligible redevelopment <br /> project costs of the approved redevelopment a�eement for the property. <br /> Page 1 of 3 <br /> 13� East Prairie Fa�ade Agreement <br />
