�. The City, by entering into this a�eement, shall not be liable to reimburse any sum <br /> of money that would be otherwise ineligible for reimbursement under the terms of <br /> the approved redevelopment a�reement. <br /> �. On the date of the completion of the exterior fa�ade renovation work described in <br /> para�aph 2 above and for the duration of the redevelopment a�reement thereafter <br /> (or until October 7, 2018, whichever date comes later), the Contract Buyer or <br /> Contract Seller shall not make any alterations, repairs, improvements or additions <br /> to, nor shall he remove any portion of, the exterior fa�ade of the building on the <br /> property, including lighting and other implements attached thereto, which would <br /> alter the visual appearance of tke exterior fa�ade of the building on the property. <br /> 6. Contract Buyer will retain the exterior fa�ade of the building on the property for <br /> the period described in paragraph 5 above in the design and character achieved <br /> � after completion of the work described in para�aph 2 above, maintaining the <br /> same at his expense in a good state of repair, subject to the terms of paragraph 5 <br /> above. <br /> 7. The term "exterior fa�ade" means all outside architectural and construction <br /> features visible from any point on the street, including, but not limited to, <br /> structural materials, facing materials, signs, windows, doors, trims, sills, steps, <br /> railings, cornices, moldings, paint colors and other decorative features. <br /> 8. Contract Buyer shall obtain at his/her expense, and shall provide proof to the City <br /> of "all risks" type of property insurance coverage on said building, naming the <br /> City as an additional insured on said policy. <br /> 9. The covenants and conditions of this agreement are covenants running with the <br /> land and insure to the benefit of the City, its successors and assigns, and are <br /> binding upon the heirs, personal representatives, successors, �antees and assigns <br /> of Contract Seller or Contract Buyer. <br /> IN WITNESS WHEREOF, the parties hereto have executed and delivered this <br /> Agreement the day and year first above written. <br /> CONTR.ACT SELLER: <br /> Page 2 of 3 <br /> 135 East Prairie Fa�ade Agreement <br />
