each occurrence, One Million Dollars ($1,000,000.00) aggregate; and (iii) a garage keepers legal <br /> liability insurance policy on a direct primary basis for comprehensive and collision perils in an <br /> amount not less than One Hundred Thousand Dollars ($100,000.00) with a deductible not <br /> exceeding Five Hundred Dollars ($500.00). <br /> (c) Prairieland also shall obtain and maintain throughout the term hereof a worker's <br /> compensation insurance policy with statutory limits and employer's liability coverage of not less <br /> than Five Hundred Thousand Dollazs ($500,000.00). <br /> (d) Prairieland has provided or shall provide to the City certificates of insurance to <br /> evidence compliance herewith, and during the term hereof will provide evidence that said <br /> insurance policies remain in effect upon the reasonable request of the City. Policies of insurance <br /> described herein requiring coverage of the City as an additional insured must name the City <br /> therein or in the declarations page, and an insurance-by-agreement clause shall not be deemed to <br /> be compliance herewith. <br /> 4. Regulation of Stored and Disposed of Vehicles. Prairieland shall provide <br /> storage and disposition of automobiles which are subject to the terms of this Agreement in a <br /> manner consistent with lawfully enacted regulations of the Illinois Commerce Commission, <br /> lawfully enacted ordinances of the City, lawfully enacted regulations of the Decatur Police <br /> Department and the provisions of the Illinois Vehicle Code, 625 ILCS 5/1-101, et seq. (1998). <br /> 5. Records. Prairieland shall keep and maintain accurate records of each <br /> vehicle towed and/or stored for the City under the terms of this Agreement, which records shall <br /> include at a minimum the following information: location from which the vehicle was towed; <br /> location to which the vehicle was towed; the date and time the vehicle was towed; the date and <br /> time the vehicle was released or otherwise disposed of by Prairieland; the manufacturer of the <br /> vehicle, together with the model and year of the vehicle; the license plate number(if any) and the <br /> state issuing the license plate (if any); the vehicle identification number of the vehicle; the <br /> identity of the person to whom the vehicle was released (if applicable) as well as the identity of <br /> the person who signed for the release of the vehicle. Inspection of the records of Prairieland as <br /> described herein shall be subject to the provisions of§ 10 hereof. <br /> 6. Providin� and Postin�of Fees and Charges. Prairi�and shall post in an <br /> accessible location at its premises all towing and storage fees, the amounts of which are set forth <br /> and incorporated herein for all purposes as Exhibit A, which posted schedule of fees and charges <br /> shali be visible to the public at the premises of Prairieland. To the extent reasonably possible, <br /> Prairieland shall provide to the owner or operator of the automobile towed or stored pursuant to <br /> the terms of this Agreement, an itemized fee schedule prior to the removal or the towing of the <br /> automobile, which itemized fee schedule shall be consistent in all respects with the amounts set <br /> forth in the schedule incorporated herein as Exhibit A, which fees, rates and charges shall not <br /> exceed the amounts of the bid provided by Prairieland to the City in relation to this Agreement. <br /> —3— <br />
