1 4 ' � � <br /> INTERGOVERNMENTAL AGREEMENT <br /> BETWEEN THE SANITARY DISTRICT OF DECATUR.A MUNICIPALCORPORATION, <br /> AND THE CITY OF DECATUR,A HOME RULE MUNICIPALCORPORATION. <br /> BOTH OF MACON COUNTY,ILLINOIS.FOR THE UNDERTAKING OF A FACILITIES PLAN <br /> AMENDMENT FOR THE BIG CREEK AND LOST BRIDGE WASTEWATER SERVICE AREAS <br /> f��i--- <br /> This Agreement made this�v day of September 2003, between the Sanitary <br /> District of Decatur, a Municipal Corporation, Macon County, Illinois("District") and the <br /> City of Decatur, a home rule Municipal Corporation, Macon County, Illinois("City"), <br /> Whereas, pursuant to Article VII Section X of the 1970 Constitution of the State of Illinois, <br /> and the Illinois Intergovernmental Cooperation Act(51LCS 220/1 et seq.), units of local <br />' government in the State of Iilinois may contract between themselves to obtain and share <br /> services and to exercise or combine functions which either unit of the local government is <br /> authorized bv law to oerform; snd <br /> Whereas,the CITY agrees that an Amendment to the existing and approved <br /> Facilities Plan for wastewater services is needed for the part of the service area known as <br /> Big Creek and Lost Bridge: and <br /> Whereas,the DISTRICT concurs that an amendment to the Facilities plan is <br /> necessary to determine the best way to provide for removal of wastewater from the service <br /> areas; and <br /> Whereas,the CITY requests the DISTRICT complete the Facilities Plan <br /> Amendment. <br /> NOW,THEREFORE,for and in consideration of the mutual covenants contained, <br /> the parties agree as follows: <br /> 1. The DISTRICT has completed and received IEPA approval its 1986 <br /> Wastewater Facilities Plan for its entire service area. <br /> 2. There has been,and is projected to be,growth and related <br /> additional wastewater flows generated in the service areas in <br /> question. <br /> 3. There have been no additional wastewater facilities constructed in <br /> the area since the original Facilities Plan. <br /> 4. Loan and Grant funding requires the approvai of a Fac�fities Plan <br /> Amendment. <br /> � <br /> 5. The DISTRICT will undertake the preparation and seek IEPA <br /> approval of a Facilities Plan Amendment for the Big Creek and Lost <br /> Bridge sections of its wastewater service area. <br /> 6. Pavment: The DISTRICT and CITY will pay for the consulting <br /> services necessary to successfully complete the Facilities Plan <br /> amendment as follows: <br /> DISTRICT and CITY will share equally in an amount <br /> not to exceed $50,000.00 ($25,000.00 each). <br /> 1 <br />
