the premises shall be used only for the temporary vehicular parking and storage of certain <br /> facilities, vehicles, machinery, materials and other equipment to be used in and on the <br /> DEVELOPMENT SITE the development of Wabash Crossing pursuant to the <br /> DEVELOPMENT AGREEMENT and this Agreement. <br /> 2. The term of this Agreement shall be eighteen (18) months from the date hereof <br /> (as such date may be extended by mutual agreement between the parties hereto),or until <br /> such time as construction of the DEVELOPMENT SITE is completed, which ever date <br /> first occurs,but subject to section 12 hereof. <br /> 3. EAST LAKE shall use vehicular access to the premises only from Marietta <br /> Street, and not from Martin Luther King, Jr. Boulevard. EAST LAKE shall install proper <br /> work zone traffic control signs, as directed by the City Engineer, to notify motorists of <br /> construction/truck traffic on Marietta Street and/or Martin Luther King, Jr. Boulevard in <br /> the vicinity of the DEVELOPMENT SITE. <br /> 4. EAST LAKE shall use commercially reasonable efforts to (i) protect existing <br /> trees from construction related traffic on Martin Luther King, Jr. Boulevard in the <br /> vicinity of the DEVELOPMENT SITE; (ii) protect certain trees to be identified by the <br /> CITY on the DEVELOPMENT SITE to the boundaries of the tree's "drip-line"; and (iii) <br /> properly supervise the activities of its contractors and the contractors of the <br /> PERMITTEES to ensure the faithful fulfillment of the terms of this Agreement. <br /> 5. EAST LAKE shall cause the premises to be fenced, as approved by the City <br /> Engineer, and shall limit its security lighting, if any, to the premises and its immediate <br /> perimeter. <br /> 6. EAST LAKE shall perform the following duties with respect to the premises: <br /> a)mow grass and other vegetation in accordance with the City Code; <br /> b) provide and use containers to prevent trash, litter and other debris from <br /> blowing or scattering from the premises; <br /> c) contain and remove liquids, such as oil, grease and gasoline, spilled by <br /> any of the PERMITTEES; and, <br /> d) remove any mud and debris tracked onto public streets from the <br /> premises, within two (2) hours of notification to do so by the CITY. <br /> 7. EAST LAKE shall provide the CITY with the name and telephone number of a <br /> contact person who may be contacted by the CITY regarding the performance of EAST <br /> LAKE'S duties and obligations hereunder. EAST LAKE shall coordinate temporary <br /> water and sewer service with the following CITY employees: <br /> Water- Steve Yeager(875-5705) and <br /> Page 2 of 4 <br />
