LEGAL DEPARTMENT MEMORANDUM
#2003-10
July 17, 2003
TO: The Honorable Mayor and City Council Members
FROM: Steve Garman, City Manager -Yv1
John W. Couter, Corporation CounselOC^i

RE: ADM Annexation Agreement
As Council is aware, ADM recently purchased the former North Water Treatment Plant
from the City. ADM now needs to expand the lagoons at the plant to handle the sludge byproduct
of the treatment process. Accordingly, it seeks to annex property immediately adjacent to the
plant and also requests a conditional use permit for such purpose. The underlying zoning (R-1,
residential) would remain the same, but ADM would be able to place the lagoons on the property.
Monday night the Council will receive a proposed annexation agreement to accomplish the
above, and also schedule a public hearing on that agreement. No formal action will be taken on
the agreement, which will only be voted upon after the public hearing. Also, prior to the Council
vote on the agreement, the Plan Corrunission will have considered the conditional use permit and
that information will be available to the Council.
