D. Termination of Project Funding <br /> The City reserves the right to suspend or terminate payment of reimbursement requests <br /> for a project in whole or in part for cause. Cause shall include the following: <br /> 1. Improper use of funds; <br /> 2. Failure to comply with the terms and conditions of this Agreement, including <br /> those specified in item C. above; <br /> 3. Failure to comply with HUD program guidelines. <br /> The City shall notify Heritage, Inc. before any such termination takes place and allow <br /> opportunity for review and correction of problems. <br /> E. Property Standards <br /> Heritage, Inc. shall ensure that all housing it constructs with HOME funds meets all <br /> applicable local codes, the 1997 Illinois Accessibility Code, HUD Housing Quality , <br /> Standards (HQS), ordinances, and zoning ordinances at the time of project completion. j <br /> Heritage, Inc. shall comply with the standards set forth by the City of Decatur for new �, <br /> construction. Payout requests for work requiring mechanical, electrical, or plumbing ', <br /> inspections shall not be processed without documentation that the applicable permits have <br /> been received and required inspections conducted. <br /> VI. TECHNICAL ASSISTANCE <br /> The City shall provide technical assistance to Heritage, Inc. upon request, at no additional <br /> cost, to guide the organization in the proper administration of the HOME funds. <br /> VII. NONDISCRIMINATION AND EQUAL ACCESS <br /> A. Affirmative Marketing <br /> Heritage, Inc. agrees that it shall affirmatively market this project to all persons within its <br /> special needs population. Heritage, Inc. will develop and adhere to an Affirmative <br /> Marketing plan which shall consist of actions to provide information and otherwise attract <br /> eligible persons in the housing market area to the project without regard to race, color, <br /> national origin, sex,religion, familial status or disability. The Affirmative Marketing plan <br /> shall be submitted to the City prior to the payout of any reimbursements requests under <br /> this Agreement. <br /> B. Fair Housing and Equal Opportunity <br /> Heritage, Inc. agrees to comply with any applicable City and State Civil Rights <br /> ordinances and with Title VI of the Civil Rights Act of 1964 as amended, Title <br /> VIII of the Civil Rights Act of 1968 as amended, Section 109 of Title I of the <br /> Housing and Community Development Act of 1974, Section 504 of the <br /> Rehabilitation Act of 1973, the Americans with Disabilities Act of 1990, the Age <br /> Discrimination Act of 1975, Executive Order 11063, Executive Order 11246 as amended <br /> 4 <br />
