1 Page 2 ' The project plans and specifications were prepared by Engineering Division staff. The project was advertised April 15, 2003, and bids were opened on April 28, 2003. The results for the letting are as follows: Compared to Engineer's Est. Bidder Bid Price Over(-Underl Engineer's Estimate $219,968.25 ----- Karnic Construction $181,353.55 (- 17.55%) Entler Excavating Co., Inc. $188,806.05 (- 14.17%) Hardsurfacing, Inc. $206,475.24 (- 6.13%) Otto Baum Company $212,453.80 (- 3.42%) Staff is recommending Entler Excavating as the lowest responsible bidder over Karnic Construction, who submitted the low bid. The General Conditions for this project requires a pre-qualification indicating that the City will only provide bidding documents to contractors who have a current Certificate of Eligibility, as issued by the State of Illinois, on file with the City. Karnic Construction does not have a Certificate of Eligibility and they were inadvertently allowed to take out bidding documents and bid on the proj ect. In terms of the requirement of this specific project, the inability to secure a Certificate of Eligibility from the State of Illinois makes Karnic Construction an unresponsible bidder. $250,000.00 has been set aside in the City's General Fund for sidewalk improvements in the City. Staff is requesting authority to expend up to $220,000 on this project if sidewalk improvement needs dictate. Staff desires to be more responsive to the citizens of the City by making a strong effort to improve the timeliness of necessary sidewalk replacement/repair work. POTENTIAL OBJECTION: Karnic Construction may object to the City's use of the State's issuance of a Certificate of Eligibility for this project. Many local contractors do not possess the State's certificate. To date, ; Karnic Construction has completed two sidewalk projects for the City. City Project 9927 was a I sidewalk ramp project with a final cost of just under$35,000 that was completed in the spring of ' 2000. City Project 9922 was a sidewalk project with a final cost of just under $85,000 that was I completed in the fall of 2000. Both projects were completed to the satisfaction of the City. City ', Project 9922 had the pre-qualification requirement of a Certificate of Eligibility, however, the ' City determined, in that instance, that Karnic had the ability to perform the work regardless of their possession of a certificate.
