the construction contracts, and all amounts, if any, paid or payable by Developer directly <br /> to materialmen or suppliers for such construction; <br /> B. All amounts paid or payable by Developer for the employment or <br /> obtaining of professional services in connection with the completion of items (a) through <br /> (c) and (e) of Article 3, including without limitation, architects, engtneers, surveyors and <br /> Developer's attorneys. The Assistant City Manager of Economic and Urban Development <br /> of Owner ("Economic Development Manager") shall be Owner's designee for approving <br /> the construction contracts with the subcontractors, and the employment of the <br /> professionals providing services in completing items (a) through (c) and (e) of Article 3, <br /> provided that the total of all such contracts and cost of employing such professionals does <br /> not exceed One Million Two Hundred Thousand Dollars ($1,200,000.00); <br /> C. Any permit fees, application fees, deposiu or license fees paid to <br /> governmental entities or utility service providers in connection with the Construction <br /> Work; and <br /> D. The "Cost of the Construction Work" shall not include any <br /> construction costs paid by any third-parties in developing any of the Outlots (as defined <br /> below). <br /> Article 7 <br /> Compensation to Developer <br /> A. Upon Developer's receipt of invoices for progress payments for the <br /> actual Cost of Construction Work pursuant to the contracts and professionals employed <br /> that are approved by Owner, Developer shall submit to Owner such invoices, with <br /> executed mechanic's lien waivers reflecting the most recent prior payment to such party <br /> � <br />
