� . � <br /> AMENDMENT NO. 1 <br /> TO <br /> CONSTRUCTION CONTRACT <br /> Between <br /> CITY OF DECATUR <br /> And <br /> KOESTER CONTRACTING CORPORATION <br /> /� � <br /> This Amendment entered into and executed this "1�� day of�����J�'� � �� , 2002, by and <br /> between the City of Decatur, hereinafter referred to as OWNER and Koester Contracting <br /> Corporation, hereinafter referred to as CONTRACTOR. <br /> Whereas, it is the mutual desire of the parties hereto to amend the Agreement entered into on <br /> August 5, 2002, hereinafter called the Agreement. The Agreement provided for Lake Decatur <br /> Basin 6 Dredging Sediment Storage Facility&Dredge Mobilization Site construction services. <br /> Therefore, it is hereby agreed that the Agreement be amended to add the following <br /> CONSTRUCTION SERVICES requested by OWNER. <br /> A. SCOPE OF SERVICES <br /> 1. Start-Up Delay Costs of Idle Equipment $24,120 <br /> 2. Additional Equipment Mobilization/Demobilization $14,490 <br /> 3. Equipment Rent—Additional Cost $50,528 <br /> 4. Extra Sugervisor Costs $18,'729 <br /> 5. Extra Rental Equipment Idle Time $36,685 <br /> B. COMPENSATION <br /> CONTRACTOR agrees to provide the CONSTRUCTION SERVICES described in <br /> this Amendment for a cost not to exceed $144,552. CONTR.ACTOR and OWNER <br /> agree that unforeseen site conditions, including weather delays, may affect the final <br /> compensation of this Amendment. <br /> C. PAYN�NTS <br /> OWNER agrees to pay CONTRACTOR as provided for in the Agreement. <br /> D. SCHEDULE <br /> This Amendment is not anticipated to cause any modification to the Agreement <br /> schedule. CONTRACTOR and OWNER agree that unforeseen site conditions, <br /> including weather delays, may affect the final completion of this Amendment. <br />
