"Hazardous Materials"means any pollutants,contaminants or industrial,toxic,hazardous <br /> or extremely hazardous chemicals,wastes,or substances which are defined,determined,classified or <br /> identified as such in any Hazardous Materials Law or in any judicial or administrative interpretation <br /> of any Hazardous Materials Law, including, without limitation, oil, petroleum, petroleum <br /> byproducts, friable asbestos, polychlorinated biphenyls and urea formaldehyde. <br /> "Hazardous Materials Law"means all Legal Requirements of any governmental authority <br /> relating to the protection of health or the environment or otherwise regulation or restricting the use, <br /> storage, disposal, treatment, handling, release andlor transportation of Hazardous Materials, <br /> including, without limitation, the Comprehensive Environmental Response, Compensation and <br /> Liability Act of 1980, the Resource Conservation and Recovery Act of 1976, the Occupational <br /> Safety and Health Act, the Clean Water Act and the regulations in 24 C.F.R. part 58. <br /> "Homeownership Plan"means any homeownership plan required to be submitted to HLJD <br /> in connection with the development of homeownership units. <br /> "HOPE VI Financing"has the meaning given in Section 4.8. <br /> "HOPE VI Grant"has the meaning given in Recital B. <br /> "HOPE VI Grant Agreemsnt"has the meaning given in Recital B. <br /> "HUD"means the United States Department of Housing and Urban Development. <br /> "IHDA"means the Illinois State Housing Development Authority or any successor agency. <br /> "Impact Area"has the meaning given in Recital C. <br /> "Infrastructure Improvements"has the meaning given in Section 3.2. <br /> "Legal Requirements" means any statute, law, act, ordinance, rule, regulation, orders, <br /> decree and ruling of any governmental authority, including any Hazardous Materials I;aw and any <br /> Public Housing Requirements,to the extent any of the foregoing are applicable to the Revitalization. <br /> "Longview Place"has the meaning given in Recital A. <br /> "Low Income Housing Tax Credits"mean the tax credit available pursuant to <br /> Section 42 of the Internal Revenue Code of 1986, as amended. <br /> "Management Agreement"has the meaning given in Section 6.9. <br /> "Management Documents"mean has the meaning given in Section 6.9. <br /> "Management Fee"has the meaning given in Section 7.4. <br /> "Market Rate"or"Market Rate Unit"means with respect to any rental or <br /> homeownership unit, that such unit does not meet the definition of Affordable hereunder. <br /> B-3 <br />
