Follows: <br /> � i. Soules shall provide bird repellent services to all properties owned by the City located <br /> _ within the boundaries set out in paragraph 2 liereof. Said s�rvices shatl be thase detiermined to be <br /> = necessary in the sole discretipn of Soules to eliminate the noisome and unsanitary accumulation <br /> of birds on City property; provided that, such�services are in strict compliance with all applicable <br /> ,� Federai, State and City statutes, vrdinances, rules and regulations, including but not limited to <br /> environmentai and conservation laws, and further provided that such services do not constitute a <br /> T_ nuisance to abutting properiy owners or the public. . <br /> r 2. The area within which Soules shall provide bird repellent services,��discussed above, <br /> �' is that area bounded by Cerro Gordo Street on the north,Franklin Street on the east, Wood <br /> Street on the south and Church Street on the.west. <br /> -- 3. The bird repellent services to be pr�vided by Soules,as required hereby, shall begin '� <br /> ` not later than October 1,2002 and shall continue through September 30, 2005. <br /> _ 4. The City shall pay Soutes for the s�rvices described herein at the�following rates, a.nd <br /> - according to the following schedule, except as provrded in paragraph� hereof: <br /> _ November l,2002-$12,OOQ, for the period Octob�r 1, 2002-September 30,2003 <br /> November l,2003- $13,000, for the period October 1,2003-September 30, 2004 <br /> - November 1, 2004- $14,000, for the period October l, 2004-September 30, 2005 <br />
