If any portion of the area described in paragraph 2 hereof is included in a s�cial <br /> - services a.rea established by the City Council;effective during the term of this Agreement, <br /> Pursuant to �5 ILCS 200/27-5 et seq., and payments for bird repelient services are included in <br /> _ the scope of such special service area,then any such special service payments to Soules for <br /> � services �n such area shall be credited to the City against any indebtedness otherwise due <br /> � <br /> ^ hereunder. It is expressly agreed that Soules shall not receive in excess of Thiriy-nine Thousand <br /> °� Hundred Dollars($39,000) from the City for bird repellent services in said described area <br /> during the term hereof,whether from payments hereunder, special service area revenues or any <br /> _ combination thereof. <br /> - 6. The City shall have the right to temunate this Agreement after the first year of service <br /> of Soules and any time during the term there after,provided that Soules shall be paid pro rata for <br /> all sums due and accrued to said date.
