I <br />� For and in consideration of the premises set out herein,the Ciiy�.nd Soules agree as I <br />... Follows: <br /> 1. Soules shall provide bird repeilent services to all properties owned by the City located <br /> _ within the boundaries set aut in paragraph 2 fiereof. Said services shall be thase determined to be <br /> - necessary in the sole discretivn of Soules to eliminate the noisome and unsanita.ry accumulation <br /> of birds on City property; provided that, such services are in strict compliance with all applicable <br /> Federal, State and City statutes, ordinances,ruies and regulations, including but nat limited to <br /> environmental and conservation laws, and further provided that such services do not constitute a <br /> Anuisance to abutting property owners or the public. . <br /> .= Z. he are 'n <br /> T a witlu which Soules shall provide bird repellent services, as discussed above, <br />=�' is that area bounded by Cerro Gordo Street on the north,Franklin Street on the east, Waod <br /> Street on the south and Church Street on the west. <br /> - 3. The bird repellent services to be provided by Soules,as required hereby, shall begin <br /> x not later than October 1,2002 and shall continue through �eptember 30, 2005. <br /> _ 4. The City shall pay Soules for the s�rvices described herein at the following rates, and <br /> ` according to the following schedule, except as provided in paragraph 5 hereof: <br /> _ November 1, 2002-$12,000, for the period October 1, 2002-September 30,2003 <br /> November l,2003- $13,000, for the period October 1, 2003-September 30,2004 <br /> - November l,2004- $14,000, for the period October 1, 2004-September 30,2005 <br />
