< . <br /> � � <br /> NEIGHBORHOOD SEWER CONSTRUCTION AGREEMENT <br /> THIS AGREEMENT is made and entered into as of this �' day of <br /> �� �� 2002 b and between HERITAGE BEHAVIORAL HEALTH <br /> • � Y <br /> CEN , an Illinois general not-for-profit corporation, <br /> (hereinafter referred to as "Heritage") , and THE CITY OF DECATUR, <br /> a municipal corporation (hereinafter referred to as "City") . <br /> RECITALS <br /> WHEREAS, Heritage owns the following real estate: <br /> Lot Three (3) of Park City Addition as recorded in Book <br /> 1832, Page 398 of the records in the Macon County <br /> Recorder' s Office (aka Lot Sixteen (16) of the Northside <br /> Addition as recorded in Book 335, Page 182 of the records <br /> in the Macon County Recorder' s Office) . Situated in <br /> Macon County, Illinois; and <br /> WHEREAS, Heritage to develop this property must improve the <br /> existing neighborhood sanitary sewer system by an extension from <br /> its present location to a location near the above property where <br /> the sewer line can then be tapped; and <br /> WHEREAS, the neighborhood sewer improvement will add value to <br /> Heritage' s property and also add value to the other properties in <br /> the same neighborhood; and <br /> WHEREAS, in order to induce Heritaqe to make these <br /> improvements and to make improvements beyond what is required for <br /> just its Heritage property, thus benefittinq the entire <br /> neighborhood, the City has agreed with Heritage to share a portion <br /> of the costs therefor; and <br /> WHEREAS, Heritage has placed the project for bids and the <br /> lowest responsible bidder is Bodine Sewer, Inc. , which has agreed <br />
