� - <br /> -2- <br /> to do the project for $179, 682, and in addition thereto, there are <br /> engineering fees incurred in the amount of $15, 600, for a total <br /> construction cost of $195, 282 . <br /> NOW, THEREFORE, in consideration of mutual covenants, <br /> agreements, conditions, representations, and warranties contained <br /> herein, and intending to be legally bound herein, the parties agree <br /> as follows : <br /> l . Heritage will accept the bid of Bodine Sewer, Inc. , and <br /> enter into a binding contract with it to complete the additional <br /> sewer system as designed, but only after said contract and <br /> construction plans are approved, in writing, by the City' s director <br /> of engineering and infrastructure . Heritage and Bodine shall <br /> comply with all applicable ordinances, codes and regulations of the <br /> City in the construction of said sewer system, including the <br /> issuance of permits therefor and the regular inspection thereof. <br /> 2 . The City agrees to pay fifty percent (50%) of the cost of <br /> the sewer project from its existing location to the near point of <br /> the Heritage property and one hundred percent (1000) of the cost of <br /> the sewer proj ect beyond that point south on Charles Street, and to <br /> pay the prorated cost for the engineering for the contract, the <br /> total of all the City' s portion is $125, 046 . The City shall have <br /> no liability to Heritage for any amount in excess of $125, 046 under <br /> the provisions of this Agreement. <br />
