AGREEMENT <br /> THIS AGREEMENT made by and between the CITY OF DECATUR, ILLINOIS ("CITY"), <br /> a municipal corporation, and the COUNTY OF MACON, ILLINOIS ("COUNTY"), a unit of local <br /> government. <br /> WHEREAS, the CITY and the COUNTY are public agencies authorized and empowered <br /> to enter agreements to combine the functions and authority exercised by each agency, as set <br /> forth in the Illinois Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq.; and, <br /> WHEREAS, pursuant to the Illinois Swimming Pool and Bathing Beach Act ("Act"), 210 <br /> ILCS 125/1 et seq., the Macon County Health Department has been duly designated as an <br /> agent of the State of Illinois Department of Public Health for the purpose of conducting <br /> inspections and investigations; and, <br /> WHEREAS, the Act requires that all public swimming pools be inspected and licensed <br /> annually to insure compliance with the Act and the rules and regulations duly promulgated <br /> thereunder by the Illinois Department of Public Health; and, <br /> WHEREAS, the COUNTY does not have personnel trained to inspect such swimming <br /> pools to determine the compliance thereof with the rules and regulations pertaining to the <br /> installation and maintenance of electrical equipment; and, <br /> WHEREAS, the COUNTY has requested that the CITY provide personnel to assist in <br /> the inspection of such swimming pools with regard to said electrical equipment; and, <br /> WHEREAS, the CITY is willing to provide such assistance, on the terms and conditions <br /> as set forth herein. <br /> NOW, THEREFORE, the CITY and the COUNTY agree as follows: <br /> 1. The COUNTY will provide written notice to the CITY'S Building Inspections Manager <br /> regarding the scheduled annual inspection of each public swimming pool in Macon County <br /> pursuant to the �ct, said notice t� be givzn not �ess that seven (7) days prior to each such <br /> inspection. <br /> 2. Upon receipt of notice of an annual inspection of a swimming pool, the CITY will <br /> provide an electrical inspector from the Inspections Division of the Department of Economic <br /> and Urban Development to accompany the inspector or inspectors from the COUNTY'S <br /> Department of Public Health in the inspection of such pool. The CITY'S electrical inspector will <br /> be an agent of the COUNTY, who shall on behalf of the COUNTY inspect the swimming pool <br /> for compliance with all provisions of the Act, and the rules and regulations duly promulgated <br /> thereunder, regarding the installation and maintenance of electrical equipment. The CITY'S <br /> electrical inspector shall provide the COUNTY with a written report of his findings with respect <br /> to each swimming pool inspected. <br /> 3. To the extent provided by law, the COUNTY shall indemnify and hold harmless the <br /> CITY and its Council members, officers, employees and agents, in both their individual and <br />
