AGREEMENT <br /> THIS AGREEMENT made b a.nd between the <br /> . y CITY OF DECATUR, ILLINOIS <br /> ("CITY"), a municipal corporation, and JAMES WII,LIAMS and EMNIY WILLIAMS <br /> (hereinafter, collectively, the "WII.,LIAMS' "). a("J- 4�3-cE�1!o I <br /> Whereas, the WILLIAMS' are the owners of the property located at 135 E. Prairie, in the <br /> City of Decatur, Illinois, and legally described as follows: <br /> Lot One (1) of the Resurvey of Lots 1, 2, 3, 4 & 8 Block 2 of Original Town of <br /> Decatur, as per Plat recorded in Book 22 Page 401 of the records in the Recorder's <br /> Office of Macon County, Illinois; and, <br /> Whereas, said property has been substantially damaged by fire, and the Williams' wish to <br /> demolish the building located thereon; and, <br /> Whereas, said building is subject to a facade easement in favor of the CITY, as recorded <br /> at Book 2618, Page 894 of the records of the Recorder's Office of Macon County ("easement"), <br /> and it is necessary that such easement be released by the CITY before said building may be <br /> demolished; and, <br /> Whereas, said demolition will also involve the temporary closing of a public street, and <br /> the CITY retains full discretion conceming said closing, in the interest of the public health, <br /> safety, welfare and economy; and, • <br /> WI�REAS, the CITY is willing to release said easement, but only on the terms and ' <br /> conditions set forth herein. ' <br /> NOW, THEREFORE, in consideration of the terms and conditions hereof, the CITY and <br /> the WII.LIAMS' agree as follows: <br /> I <br />
