l. The recitations contained in the preamble hereof are incorporated herein and are I <br /> considered part of this agreement. � <br /> 2. The CITY will issue a demolition permit for said building to the WII.,LIAMS', or their <br /> agent, subject to all usual and customary requirements as mandated by applicable codes and <br /> ordinances, including naming the CITY as additional insured on such insurance as is required by <br /> the CITY'S Risk Manager, and also subject to sections 3 through 6 hereof. <br /> 3. The CITY will issue the demolition permit, as described in section 2 hereof, not later <br /> than ninety (90) da.ys after the submitta.l of an application therefor which meets all requirements <br /> as outlined herein. <br /> 4. The WILLIAMS' agree to submit to the CITY's Planning Division sta.ff an elevation <br /> drawi.ng of any new building proposed to be constructed after demolition of the current structure, <br /> showing all visible elevations. These elevations shall be drawn by an Architect registered in the <br /> State of Illinois and shall indicate exterior features, materials used, and proposed colors. <br /> 5. The-design of the new building referred to in Section 4 hereof shall be consistent with <br /> the historical nature of the downtown area and shall contain a minimum of two (2) stories. In <br /> addition, the elevation shall show, to the greatest degree possible, reuse of architectural features <br /> on the facade of the current structure. <br /> 6. No permits for construction of any new building shall be approved unless the plans <br /> accompanying such permit are consistent with the previously approved elevation drawings. <br /> 7. Upon completion of the demolition of said building pursuant to the permit referred to <br /> in Section 2 hereof, and after acceptance thereof by the CITY, the CITY shall release the <br /> easement referred to herein. <br /> 8. The CIT'Y and the WILLIAMS' each release and hold the other party harmless for any <br /> costs, damages or causes of action incurred by either party which are caused by the actions of the <br /> other party pursuant to and in conformance with the terms of this agreement. � <br /> 9. Nothing contained in this agreement shall preciude the CITY from obtaining a court <br /> order for demolition, pursuant to 65 ILCS 5/11-31-1 et seq., if the WILLIAMS' do not timely <br /> demolish said building, and such order shall render tlus agreement null and void and neither <br /> party hereto shall have any rights or obligarions hereunder. <br /> 10. The terms and conditions hereof aze a covenant running with the land, and are � <br /> binding on the heirs, successors and assigns of the parties hereto for the term hereof. <br />
