5(a). ADM agrees to observe and comply with the "Prevailing Wage AcY', 820 ILCS <br /> 130 et. seq. and with all rules, regulations, ordinances, statutes and zoning laws now in force <br /> or that may be enacted during the continuation of this lease by the City or any other <br /> Municipality, County, State or Federal authority which apply to Garage B and to indemnify <br /> the City for any damage caused by violation thereof. <br /> 5(b). ADM shall observe all rights and comply with all laws pertaining to taping or <br /> recording activity in Garage B, and shall indemnify the City for any costs incurred or <br /> damages assessed due to any violations thereof. ADM shall make any such tapes or <br /> recordings available to the Decatur Police Department upon request. <br /> 6. To the extent provided by law, ADM, in using the premises, does so at its own risk. <br /> The City shall not be liable for any property damages incurred by ADM on the premises or <br /> any portion thereof. To the extent provided by law, ADM does hereby fully and forever on its <br /> own behalf release and discharge the City and the City Council members, City employees, <br /> officers and agents, in both their individual and official capacities, from any and all claims, <br /> demands, damages, rights of action or causes of action, present or future, whether known or <br /> unknown, anticipated or unanticipated, sounding in contract or tort, arising out of ADM's use <br /> of Garage B, and out of the performance of any work contracted by ADM for improvements <br /> and repairs to Garage B. <br /> 7. To the extent provided by law, ADM shall indemnify and hold harmless the City <br /> and its Council members, officers, employees, and agents, in both their individual and official <br /> capacities, from all claims for bodily injury, death or property damage resulting from or <br /> arising out of ADM's use of Garage B including any improvements or fixtures installed or <br /> added by ADM under Paragraph 11. <br />
