all of its industrial cooling and process water requirements for its East and West plants and for <br /> facilities located in Macon County, Illinois, of ADM or any wholly or majority owned subsidiary <br /> of ADM except for facilities of any current or former "large user" of the City's water system, <br /> other than ADM, as that term is defined in Chapter 64 of the City Code, or any subsidiary or <br /> affiliate of such large user. All water produced by ADM at the North Plant shall be obtained <br /> from Lake Decatur in accordance with this Agreement. Notwithstanding, in the event that ADM <br /> shall learn of an alternative source of raw water supply, other than ADM's wells and recycled <br /> wastewater, the parties are agreeable to discuss and negotiate respecting possible use of such <br /> alternative supply by ADM. Notwithstanding any other provision hereof, nothing herein shall be <br /> deemed ar construed to prevent or prohibit ADM from using ADM's recycled wastewater to <br /> satisfy a portion of the industrial cooling and process water requirements of its East and West <br /> Plants and for facilities of ADM located in Macon County, Illinois or any wholly or majority <br /> owned subsidiary of ADM, except for facilities of any current or former "large user" of the <br /> City's water system, other than ADM, as that term is defined in Chapter 64 of the City Code, or <br /> any subsidiary or affiliate of such large user. <br /> 3. Take Points and Meterin�. ADM will take water from the City under this <br /> Agreement at a meter or meters to be installed on the North Plant intake(s). A meter or meters <br /> shall also be installed at a point or points to measure water returned to the Lake from and during <br /> the treatment process and not used by ADM. The meter or meters shall be real time metering <br /> with telemetering to the City, of a design and type approved by the City in writing in advance of <br /> installation and shall be purchased and installed at ADM's sole cost. The exact location of the <br /> meters and their installation shall be subject to the prior written approval of the City. <br /> 2 <br />
