b. Section 6(i) of the Purchase Agreement is hereby amended by adding the <br /> following sentence as the second sentence thereof: <br /> "Notwithstanding the foregoing, nothing herein shall be deemed or <br /> construed to prevent or prohibit ADM from producing potable water at the <br /> North Plant for use at ADM's East or West Plants or for any facilities of <br /> ADM in Macon County, Illinois or of any wholly or majority owned <br /> subsidiary of ADM except far facilities of any current or former"large <br /> user" of the City's water system, other than ADM, as that term is defined <br /> in Chapter 64 of the City Code, or any subsidiary or affiliate of such large <br /> user." <br /> 3. Changes to Section 8 of the Purchase Agreement. <br /> a. The first, second, and third sentences of Section 8 of the Purchase <br /> Agreement are hereby deleted in their entirety. The fourth sentence of <br /> Section 8 is hereby amended and restated in its entirety as follows: <br /> "Water obtained by ADM from the City for its industrial cooling and <br /> process water supply requirements shall be isolated by ADM from its <br /> water purchases from the City for potable water applications." <br /> 4. Changes to Section 9 of the Purchase Agreement. <br /> a. Section 9 of the Purchase Agreement is hereby amended by adding the <br /> following sentence as the final sentence thereo£ <br /> "Notwithstanding any other provision hereof, nothing herein shall be <br /> deemed or construed to prevent or prohibit ADM from using ADM's <br /> recycled wastewater to satisfy a portion of the industrial cooling and <br /> process water requirements of its East and West Plants and for facilities of <br /> ADM located in Macon County, Illinois or any wholly or majority owned <br /> subsidiary of ADM, except for facilities of any current or former"large <br /> user" of the City's water system, other than ADM, as that term is defined <br /> in Chapter 64 of the City Code, or any subsidiary or affiliate of such large <br /> user." <br /> 5. Changes to Section 10 of the Purchase Agreement. <br /> a. Section 10 of the Purchase Agreement is hereby amended and restated in <br /> its entirety as follows: <br /> "ADM shall employ reasonable policies, programs and equipment to avoid <br /> wasteful use of water produced at the North Plant. ADM shall annually <br /> make a report to the City as to production and usage at the North Plant." <br /> 2 <br />
