Section 2 of the Raw Water Supply Agreement is hereby amended by <br /> adding the following sentence as the final sentence thereo£ <br /> "Notwithstanding any other provision hereof, nothing herein shall be <br /> deemed or construed to prevent or prohibit ADM from using ADM's <br /> recycled wastewater to satisfy a portion of the industrial cooling and <br /> process water requirements of its East and West Plants and for facilities of <br /> ADM located in Macon County, Illinois or any wholly or majority owned <br /> subsidiary of ADM, except for facilities of any current or former"large <br /> user" of the City's water system, other than ADM, as that term is defined <br /> in Chapter 64 of the City Code, or any subsidiary or affiliate of such large <br /> user." <br /> 7. Changes to Section 3 of the Raw Water Supply Agreement. <br /> a. Section 3 of the Raw Water Supply Agreement is hereby amended and <br /> restated in its entirety as follows: <br /> "ADM will take water from the City under this Agreement at a meter or <br /> meters to be installed on the North Plant intake(s). A meter or meters <br /> shall also be installed at a point or points to measure water returned to the <br /> Lake from and during the treatment process and not used by ADM. The <br /> meter or meters shall be real time metering with telemetering to the City, <br /> of a design and type approved by the City in writing in advance of <br /> installation and shall be purchased and installed at ADM's sole cost. The <br /> exact location of the meters and their installation shall be subject to prior <br /> written approval of the City. <br /> 8. Changes to Section 4 of the Raw Water Supply Agreement. <br /> a. Section 4(a) of the Raw Water Supply Agreement is hereby amended and <br /> restated in its entirety as follows: <br /> "ADM shall not withdraw raw water from Lake Decatur in excess of 24 <br /> MGD, with a day being measured as a 24 hour period beginning at <br /> midnight." <br /> b. Section 4(b) of the Raw Water Supply Agreement is hereby amended and <br /> restated in its entirety as follows: <br /> "The City shall have reasonable access to the North Plant for inspection <br /> and disconnection of supply, if such disconnection is permitted pursuant to <br /> 3 <br />
