SECTION II <br /> Duties and Powers of "EMPLOYER" <br /> In general, "EMPLOYER" shall have the following duties and obligations: <br /> 2.01 Deposits to Claims Account. "EMPLOYER" shall establish a special checking account in <br /> their designated bank for the purposes of funding eligible claims processed on behalf of <br /> "EMPLOYER"by the"Administrator". It will be the responsibility of "EMPLOYER"to <br /> make sure tha.t the clairns are always properly funded. <br /> 2.02 Distribution of Participant Enrollment/Benefits Forms. "EMPLOYER" shall approve <br /> Forms provided by the"Administrator"for this purpose and for the purpose of making <br /> Participant benefits claims. All applications for benefits shall be referred promptly to the <br /> "Administrator"for processing. <br /> 2.03 Provision of Partici�ant Status Information. "EMPLOYER" sha.11 furnish the <br /> "Administrator"with a complete list of all current Participants as defined in Pazagraph <br /> 1.09. During the continuance of this Agreement, "EMPLOYER"or its members shall <br /> report to the "Administrator"the termination(s), death, eligibility for Medicare, eligibility <br /> for COBRA continuation, or change to part-time status of every eligible Employee as <br /> soon as possible and on a timely basis after the occurrence of such event and the death, <br /> divorce or legal separation, or other loss of dependent status of every eligible Dependent <br /> as soon as possible and on a timely basis after the date that"EMPLOYER"member <br /> becomes aware of such change in status. <br /> 2.04 Arbiter of Participant Eli i�bility for Participation and Benefits. "EMPLOYER" shall <br /> possess the ultimate authority to decide all questions of eligibility for Plan participation <br /> and termination of participation as well as for payment of benefits to Plan Participants. <br /> 2.05 Indemnification. "EMPLOYER" sha11, except to the e�ctent set forth in Paragraph 9.03, <br /> indemnify and hold the "Administrator"harmless from any claim by any Participant past or <br /> present. <br /> 2.06 Pa,yment of Fees. "EMPLOYER" shall pay(or authorize payment from the Claims <br /> Account) the "Administrator"the fees specified in Section VII of this Agreement. <br /> 2.07 Employee Benefit Booklets. "EMPLOYER" shall have responsibility for the payment of <br /> all printing costs associated with the preparation of employee benefit booklets, unless <br /> otherwise stated on the Fee Schedule. <br /> 2.08 Discretion and Authoritv. "ENIPLOYER" shall have absolute authority with respect to <br /> the control, ma,nagement, investment, disposition or utilization of Plan assets. <br /> "EMPLOYER", ma.y however, instruct the"Admini.strator"to utilize Plan assets in any <br /> manner it deems proper. <br /> 3 <br />
