r ��' <br /> "' r , <br /> LICENSE AGREEMENT ' <br /> This a eement made this ��-/� da of �'U-� � 2001 between the <br /> gr Y , , <br />� City of Decatur, Illinois (Decatur), and the Decatur Park District (District). <br /> I RECITALS: <br /> WHEREAS,Decatur and District are units of local government as defined by <br /> Article VII of the Constitution of the State of Illinois and public agencies as defined by <br /> the Intergovernmental Cooperation Act (5 ILCS 220/1 et seq.) and are, therefore, <br /> authorized and empowered to enter into intergovernmental agreements; and <br /> WHEREAS,the District is constructing a bicyle path/walkway trail (bike path) <br /> parallel to Sunset Avenue; and <br /> WHEREAS,the construction of the bike path will increase the need for parking on <br /> Sunset Avenue; and <br /> WHEREAS, Decatur and District have agreed to enter into this License Agreement <br /> which will set forth the terms and conditions of the District's licensed use of Decatur's <br /> property for parking. <br /> NOW, THEREFORE, for and in consideration of the herein contained mutual <br /> promises and covenants, Decatur and District agree as follows: <br /> l. Decatur hereby grants to District a non-exclusive license to utilize that portion <br /> of Decatur's property as specified on attached Exhibit A for the purpose of constructing, <br /> operating and maintaining a bike path trailhead parking lot and for no other purpose. <br /> 2. The license granted hereunder shall commence on the date of this agreement <br /> and shall continue so long as the parking lot is maintained by the District for the purposes <br /> set forth herein. <br />
