Y • ► <br /> , LICENSE <br /> This Agreement made this���day of l� , 2001 between the City of <br /> Decatur, Illinois, ("Decatur"), and the Village of syth, Il ' ois ("Forsyth"). <br /> RECITALS: <br /> WHEREAS, Decatur and Forsyth are units of local governxnent as defined by <br /> Article VII of the Constitution of the State of Illinois,and public agencies,as defined by the <br /> Intergovernmental Cooperation Act(5 ILCS 220/1 et seq.),and are therefore authorized and <br /> powered to enter into intergovernmental agreements; and <br /> WHEREAS, the Village of Forsyth is constructing a bicycle path/walkway trail <br /> ("bike path")which will eventually be interconnected with a similar system constructed by <br /> Decatur; and <br /> WHEREAS,the construction of the Forsyth bike path as proposed to be constructed <br /> will encroach upon the right-of-way of McDonald Avenue at a location where it is a <br /> dedicated street of Decatur; and <br /> WHEREAS,Decatur and Forsyth have agreed to enter into this License Agreement i <br /> � <br /> which will set forth the terms and conditions of the placement of the bike path. ,I <br /> NOW, THEREFORE, for and in consideration of the herein contained mutual <br /> promises and covenants, Decatur and Forsyth agrees as follows: <br /> 1. Decatur hereby grants to Forsyth a non-exclusive license to utilize that <br /> portion of the right-of-way of McDonald Avenue as specified on attached Exhibit "A" for <br />
