- - 2 - the purpose of constructing,operating and maintaining the bike path and for no other purpose. The License granted hereunder shall commence on the date hereof and shall continue so long as the bike path is maintained by Forsyth for the purposes set forth herein. 2. This Agreement creates a license only and Forsyth agrees that it will not at any time claim any interest or estate of any kind or extent whatsoever in the right-of-way of McDonald Avenue within the city lirnits af Deca.tur bv virtue of this license. 3. Forsyth agrees,at its own expense,to do all necessary construction,mainte- nance and repair of the bike path pursuant to the plans and specifications prepared by BGM Engineering, Inc. 4. Forsyth agrees that Decatur shall not be responsible for any maintenance or safety in the operation of the bike path. 5. Forsyth agrees to protect, indemnify and save Decatur harmless from and against any liability or claims of any kind or character due to injury or death of any person or damage to any property arising out of the construction, maintenance or operation of the bike path. 6. Decatur may temporariiy interrupt Forsyt.i`s and the public's use of the licensed premises to repair and maintain the adjacent area of McDonald Avenue. 7. Decatur reserves the right of ingress and egress over the licensed premises. 8. This Agreement may be executed in counterparts, each of which shall be deemed to be an original and all of which shall together constitute one and the same instrument.
