- - 2 - <br /> the purpose of constructing,operating and maintaining the bike path and for no other purpose. <br /> The License granted hereunder shall commence on the date hereof and shall continue <br /> so long as the bike path is maintained by Forsyth for the purposes set forth herein. <br /> 2. This Agreement creates a license only and Forsyth agrees that it will not at <br /> any time claim any interest or estate of any kind or extent whatsoever in the right-of-way of <br /> McDonald Avenue within the city lirnits af Deca.tur bv virtue of this license. <br /> 3. Forsyth agrees,at its own expense,to do all necessary construction,mainte- <br /> nance and repair of the bike path pursuant to the plans and specifications prepared by BGM <br /> Engineering, Inc. <br /> 4. Forsyth agrees that Decatur shall not be responsible for any maintenance or <br /> safety in the operation of the bike path. <br /> 5. Forsyth agrees to protect, indemnify and save Decatur harmless from and <br /> against any liability or claims of any kind or character due to injury or death of any person <br /> or damage to any property arising out of the construction, maintenance or operation of the <br /> bike path. <br /> 6. Decatur may temporariiy interrupt Forsyt.i`s and the public's use of the <br /> licensed premises to repair and maintain the adjacent area of McDonald Avenue. <br /> 7. Decatur reserves the right of ingress and egress over the licensed premises. <br /> 8. This Agreement may be executed in counterparts, each of which shall be <br /> deemed to be an original and all of which shall together constitute one and the same <br /> instrument. <br />
