Howley and City Council Members
FROM: Steve G ity Manager
A.J. Krieger, sistant City Manage
SUBJECT: Termination of Leaf Vacuuming Contract
RECOMMENDATION:
Approval of the attached resolution will terminate the current leaf vacuuming agreement with
Suburban, thereby waiving each party's rights to any further claims andlor payrnents. Staff
recommends approval.
BACKGROUND:
The effect of this resolution is the termination of the current five year leaf vacuuming agreement.
This termination was originally proposed by Suburban, and final terms and conditions have been
agreed to, and approved of, by Suburban's attorney Ed Flynn.
Approval of the resolution will reduce the amount of leaf vacuuming payments made by the City
to Suburban to $518,800, from the original year-one contract amount of $653,200. The
$518,800 figure includes the one time, front-end fee of$250,000.
Pending approval of the resolution, it is City stas recommendation that a final version of a
' proposed leaf vacuurning contract be prepared, in a generic form, and distributed for the purpose
of generating leaf vacuuming propasaLs. City staff could prepare a generic version of the leaf
vacuuming agreement, and seek leaf vacuuming proposals from qualified firms. This request
would ask potential leaf vacuuming firms to propose an annual cost only, and to bid a contract
price for each year of a five year agreement. Final proposals would need to be received by
Tuesday, July 2, 2001. Only frms demonstrating experience with the operation of large scale
vacuuming projects will be considered.
Based on the proposals, a study session will be scheduled to determine:
1. Council's direction regarding a five-yeaz contract for city-wide leaf vacuuming;or
2. Council's consideration of alterna.tive landscape waste/leaf removal plans.
Pending consideration of available options, a final plan/contract can be prepared and presented for
Council consideration at its July 16, 2001, regular meeting.
POTENTIAL OBJECTION:
City staff is not presently aware of any opposition to the termination of this leaf vacuuming
agreement with Suburban.
STAFF REFERENCE:
If Council members have questions they may contact A.J.
