2.0 COMMUNICATIONS <br /> 2.1 FORMAT <br /> Communications in connection with this Agreement shall be in writing; communications <br /> received by facsimile(FAX)machine shall be accepted. All written communications <br /> shall be addressed to the officer(s) or employee(s) of the CITY and the OWNER'S <br /> REPRESENTATIVE designated to receive such communications. Telephone calls and <br /> e-mail may be used to expedite communications,but shall not be official communication <br /> unless confirmed in writing. <br /> 2.2 OFFICIAL RECEIPT <br /> Communications shall be considered received at the time actually received by the <br /> addressee or designated agent and shall be effective upon the date of receipt. <br /> 2.3 OFFICIAL ADDRESS <br /> For purposes of this agreement, all notices and other communications shall be addressed <br /> to the respective parties as follows: <br /> CITY OWNER'S REPRESENTATIVE <br /> The City of Decatur, Illinois Blank, Wesselink, Cook Construction Managers, Inc <br /> 555 East Wood Street P.O. Box 2910 <br /> Decatur, IL 62523 Decatur, IL 62524-2910 <br /> 2.4 CONTACT PERSONS <br /> The persons to whom notices shall be addressed are: <br /> • CITY: Paul McChancy, Mass Transit Administrator <br /> • OWNER'S REPRESENTATIVE: Joseph D. Cycotte, Vice President of Operations <br /> 3A TERM OF SERVICE I <br /> This agreement shall become and be effective as of ��y ��� , 2001, and <br /> shall continue in effect until construction of the multi-modal transportation facility in Decatur, <br /> Illinois (hereinafter referred to as the FACILITY) is completed, and a letter of substantial <br /> completion is issued by the Architect to the building contractor. <br /> Although the CITY desires and anticipates the orderly and timely completion of this project, it <br /> cannot guarantee that delays will not occur. The schedule of work and the date of completion are <br /> subject to the schedules of the building contractors constructing the multi-modal facility. <br /> The OWNER'S REPRESENTATIVE's obligation to render services hereunder will extend for <br /> the period required for the final completion of the FACILITY, including construction of the <br /> building and site development as shown on the approved plans. If the OWNER'S REPRESEN- <br /> TATIVE provides service beyond 300 days (the building contractor's estimate for completion of <br /> the facility) from the effective date of this Agreement, then the OWNER'S REPRESENTATIVE's <br /> obligation to render service, as defined in section 4 below, will extend into additional services, as <br /> defined by Article 3 of AIA B801/CMa, until the FACILITY is completed. <br /> Decatur Public Ti•ansit System <br /> Owner's Rep�•esentative 2 <br />
