C) claims for damages because of bodily injury, sickness or disease, or death of <br /> any person other than the OWNER'S REPRESENTATIVE's employees; <br /> D) claims to damages insured by usual personal injury liability coverage which <br /> are sustained(1)by a person as a result of an offense directly or indirectly <br /> related to employment of such person by the OWNER'S REPRESENTATIVE, <br /> or(2)by another person; <br /> E) claims for damages, other than to the Work itself,because of injury to or <br /> destruction of tangible property, including loss of use resulting therefrom; <br /> F) claims for damages because of bodily injury, death of a person or property <br /> damage arising out of ownership,maintenance or use of a motor vehicle. <br /> The OWNER'S REPRESENTATIVE shall list the CITY as an additional insured on all <br /> such insurance policies. <br /> 6.2 LIMITS ON INSURANCE <br /> All such insurance as indicated above shall be written for not less than$3,000,000.00 <br /> (three million dollars) or the amount required by law, whichever coverage is greater. <br /> Coverages, whether written on an occurrence or claims-made basis, shall be maintained <br /> without interruption from date of commencement of operations under this Agreement <br /> until date of final payment and termination of any coverage required to be maintained ', <br /> after final payment. <br /> 6.3 PROOF OF INSURANCE � <br /> Proof of insurance shall be submitted to the CITY within 30 days of the date execution of <br /> this Agreement, and before the OWNER'S REPRESENTATIVE commences any of the <br /> parts of the work of the Agreement. The OWNER'S REPRESENTATIVE agrees that if <br /> any policy of insurance is in effect in such manner as to affect the insurance called for <br /> herein, 30 days notice in writing shall be given to the CITY prior to any such change or <br /> cancellation. <br /> 6.4 WAIVER OF RIGHTS <br /> The OWNER'S REPRESENTATIVE and all of its insurers shall waive all rights of <br /> recovery or subrogation against the CITY and its insurance companies. <br /> 6.5 SAFETY RULES AND REGULATIONS <br /> The OWNER'S REPRESENTATIVE shall endeavor to make the construction contractor <br /> comply with all safety rules and regulations of the Federal Occupational Safety and <br /> Health Act of 1970 and those of all applicable CITY Acts, Laws or Regulations during <br /> the construction of the FACILITY. <br /> 6.6 NOTICES <br /> 'The CITY will give the OWNER'S REPRESENTATIVE prompt notice in writing of the <br /> institution of any suit or proceeding and permit the OWNER'S REPRESENTATIVE to <br /> defend same, and will give all needed information and assistance to enable the OWNER'S <br /> REPRESENTATIVE to do so. The OWNER'S REPRESENTATIVE shall similarly give <br /> Decatur Public Ti-ansit System <br /> Owner's Representative 6 <br />
