8.0 COMPLIANCE WITH LAWS PERMITS AND LICENSES <br /> The OWNER'S REPRESENTATIVE will give all notices and comply with all Federal and State, <br /> laws, ordinances,rules, regulations, standards, and orders of any public authority bearing on the <br /> work to be performed under this sContract, including, but not limited to, the laws referred to in <br /> these General Provisions of the Agreement and the other Agreement Documents. If the <br /> Agreement Documents are at variance therewith in any respect, any necessary changes shall be <br /> adjusted by appropriate modification. Omission of any applicable laws, ordinances,rules, <br /> regulations, standards or orders by the CITY in the Agreement Documents shall be construed as <br /> an oversight and shall not relieve the OWNER'S REPRESENTATIVE from his obligations to <br /> meet such, fully and completely. Upon request, the OWNER'S REPRESENTATIVE shall <br /> furnish to the CITY certificates of compliance with all such laws, orders and regulations. The <br /> OWNER'S REPRESENTATIVE shall be responsible for obtaining all necessary permits and <br /> licenses required for performance under the Contract. <br /> Applicable provisions of all Federal and State laws, and of all ordinances,rules, and regulations <br /> shall govern any and all claims and disputes which may arise between the OWNER'S <br /> REPRESENTATIVE and the CITY,by and through its officers, employees and authorized <br /> representatives, or any other persons, natural and otherwise, and lack of knowledge by the <br /> OWNER'S REPRESENTATIVE shall not constitute a cognizable defense against the legal effect <br /> thereof. <br /> 9.0 REOUIRED CLAUSES <br /> The OWNER'S REPRESENTATIVE must comply with all applicable Federal Transit <br /> Administration clauses including,but not limited to those listed in this section. Federal , <br /> requirements may change and the changed requirements will apply to the project as required, <br /> unless the Federal Government determines otherwise. The OWNER'S REPRESENTATIVE or � <br /> subcontractor shall insert in any subcontracts all of the clauses set forth in this section"9.0. , <br /> Required Clauses", and also a clause requiring the subcontractors to include these clauses in any ii <br /> lower tier subcontracts. The OWNER'S REPRESENTATIVE shall be responsible far '�� <br /> compliance by any subcontractor or lower tier subcontractor with the clauses set forth in this ' <br /> section. <br /> 9.1 INELIGIBLE CONTRACTOR <br /> A. The OWNER'S REPRESENTATIVE shall certify that it is not included in the U.S. <br /> Comptroller General's list of ineligible contractors (Attachment B), or it shall provide an <br /> explanation as to why it cannot provide the signed certification. <br /> B. The inability of a person to provide the required certification will not necessarily <br /> result in denial of participation in this covered transaction. The prospective participant <br /> shall submit an explanation of why it cannot provide the certification set out. The <br /> certification or explanation will be considered in connection with the CITY's <br /> determination whether to enter into this transaction. However, failure of the prospective <br /> primary participant to furnish a certification or an explanation shall disqualify such <br /> person from participation in this transaction. <br /> Decatur Public Transit System <br /> Owner's Repi•esentative 8 <br />
