9.3 INTEREST OF MEMBER OF OR DELEGATE TO CONGRESS <br /> No member of or delegate to the Congress of the United States or to the Illinois General <br /> Assembly shall be admitted to any share or part of this Agreement or to any benefit <br /> arising therefrom. <br /> 9.4 NON-COLLUSION <br /> The OWNER'S REPRESENTATIVE guarantees that the proposal it submitted is not a <br /> product of collusion with any other bidder and no effort has been made to fix the proposal <br /> price of any bidder or to fix any overhead, profit or cost element of any proposal price. <br /> (Attachment C.) <br /> 9.5 EQUAL EMPLOYMENT OPPORTUNITY <br /> OWNER'S REPRESENTATIVE will be required to comply with all applicable Equal <br /> Employment Opporiunity laws and regulations. In connection with this project, the <br /> OWNER'S REPRESENTATIVE shall not discriminate against any employee or <br /> applicant for employment because of race, religion, color, sex, national origin or <br /> disability. The OWNER'S REPRESENTATIVE shall take affirmative action to ensure <br /> that qualified and approved applicants are employed, and that employees are treated <br /> during employment without regard to their race, religion, color, sex, or national origin. <br /> Such action will include,but not be limited to the following: employment, upgrading, <br /> demotion,recruitment advertising, layoff, transfer, or termination, rates of pay or other <br /> compensation, and selection for training, including apprenticeship. The OWNER'S <br /> REPRESENTATIVE shall also notify any and all suppliers or subcontractors of his <br /> obligations under this agreement related to this provision. <br /> In the event of the OWNER'S REPRESENTATIVE's non-compliance with any <br /> provisions of this Equal Employment Opportunity Clause, the Illinois Human Rights Act <br /> Rules and Regulations of the Illinois Department of Human Rights ("Department"), the <br /> OWNER'S REPRESENTATIVE may be declared ineligible for future contracts ar <br /> subcontracts with the State of Illinois or any of its political subdivisions or municipal <br /> corporations, and the agreement may be canceled or voided in whole or in part, and such , <br /> other sanctions or penalties may be imposed or remedies invoked as provided by statute � <br /> or regulation. During the performance of this contract, the OWNER'S ��,, <br /> REPRESENTATIVE agrees as follows: i <br /> A) That it will not discriminate against any employee or applicant for employment <br /> because of race, color, religion, sex, national origin, ancestry, age, physical or mental <br /> handicap unrelated to ability, or an unfavorable discharge from military service; and <br /> further, that it will examine all job classifications to determine if minority persons or <br /> women are underutilized and will take appropriate affirmative action to rectify any such <br /> underutilization. <br /> B) That, if it hires additional employees in order to perform this agreement or any portion <br /> thereof, it will determine the availability(in accordance with the Deparhnent's Rules and <br /> Regulations) of minorities and women in the area(s) from which it may reasonably recruit <br /> and it will hire for each job classification for which employees are hired in such a way <br /> that minorities and women are not utilized. <br /> Decatur Public Ti�ansit System <br /> Owner's Representative 10 <br />
