IX. FORCE MAJEURE. The parties to this contract shall be excused from performance <br /> hereunder during the time and to the extent they are prevented from obtaining or performing the <br /> service,by reason of act of God, fire, reduction or failure of power source, failure of the system's <br /> environment, commandeering of materials,products, plants, or facilities by the government, <br /> when satisfactory evidence is presented to the other party,provided that it is reasonably <br /> established by presentation of facts,that the non-performance is not due to the fault or neglect of <br /> the party who is not performing. <br /> X. ACCEPTANCE TESTING. <br /> A. A systems acceptance test shall be conducted to ensure that all hardware, software, other <br /> equipment, and services rendered under this contract meet standards of acceptance and <br /> performance and are free from defects which would affect the operating condition of the system. <br /> Logical will perform the following Acceptance Test Plan to verify that all furnished equipment, <br /> software, interfaces, and data operates in accordance with the requirements of this contract. <br /> Logical technicians, working with Barbeck Communications, will install and demonstrate the <br /> functionality of the Aironet Wireless equipment installed as part of the current project. The <br /> wireless equipment will be tested for: <br /> 1. Signal strength to ensure adequate headroom for minor physical deviations in the <br /> futuxe. <br /> 2. Connectivity from each site to all other locations in the network,by sending files <br /> across the network. <br /> 3. Use of network tools to determine, as reasonably accurate as possible, that the <br /> throughput is up to normal standards. <br /> 4. WAN failover to the ISDN circuits so the city knows that the automatic backup works. <br /> B. Prior to acceptance testing, the City must be in receipt of all software,user/technical manuals, <br /> and any other hardware/software support items specified. The Consultant will have a <br /> representative readily available for the duration of acceptance testing and for post-installation <br /> evaluation. <br /> C. The Consultant shall certify in writing to the City that the system is installed and ready for <br /> acceptance testing. <br /> D. If, for any reason,before final acceptance is made of the equipment, software, data installed, <br /> or other services performed, it is found to be defective or not as warranted and/or contracted for, <br /> the City may refuse to accept it and the Consultant shall be so advised and shall be required to <br /> Page 10 of 12 Pages <br />
