Excerpts from Plan Commission Minutes of April l, 2004 Cal. No. 04-19 Petition of DANE C. BRAGG, Director of Economic and Urban Development Department for an amendment to the City of Decatur Zoning Ordinance (Ord. #3512, as amended). Ms. Kathy Miller was sworn in by Ms. Jesse. Ms. Miller presented the following recommendation of staff. Currently the City of Decatur Zoning Ordinance only allows Animal Clinics and Hospitals (Veterinarian and/or animal clinic or riding academy) in the M-1 Light Industrial District. Staff would like to amend the Ordinance to expand the number of Districts that Animal Clinic (with and without outdoor kennels) may operate. In SECTION II, DEFINITIONS a definition for ANIMAL CLINIC OR HOSPITAL will be added: A place where small animals, including household pets are given medical or surgical treatment and are cared for during the time of such treatment. Kennel use shall be limited to short-time boarding, incidental to hospital use and such kennels shall be located within the building(unless expressly permitted outdoors). The proposed amendment will add Animal Clinic or Hospital,without outdoor kennels to SECTION X (O-1 District), SECTION XI(B-1 District), SECTION XII(B-2 District), and SECTION XIV (B-4 District) in the Permitted Uses list. It will also add"Animal Clinic or Hospital with outdoor kennel located at least 100 feet from any Residential District"to the list of Conditional Uses in SECTION XII (B-2 District). In SECTION XVI(M-1 District) and SECTION XVII (M-2 District), Animal Clinic or Hospital, with outdoor kennel located at least 100 feet from any Residential District will be added to the Permitted Uses list. In SECTION XVI. A. (M-1 District) Veterinaxian and/or animal clinic or riding academy will be deleted and Riding academy will be added to the Permitted Uses list. Staff recommends approval of the amendments as proposed. SECTION XXIX. G. of the Zoning Ordinance requires the City Plan Commission to hold a public hearing and make recommendations to the City Council on proposed amendments to the Zoning Ordinance. A motion to forward the request of Cal. No. 04-19 to the City Council with a recommendation of approval is suggested.
