Miller, ICP, Senior Planne���/ <br /> Suzan Stickle, Planner Sr�� <br /> SUBJECT: Amendments to the Zoning Ordinance (Ordinance#3512) <br /> SUMMARY RECOMMENDATION: Staff recommends approval of the amendments to the <br /> City of Decatur Zoning Ordinance (Ordinance # 3512) as proposed. The City Plan Commission <br /> voted 6-0 to recommend approval of this petition at the January 6, 2004 hearing; the minutes of <br /> the meeting are attached. <br /> BACKGROUND: The current City of Decatur Zoning Ordinance was adopted in May of 2002. <br /> Since the time of adoption, staff has discovered certain necessary changes, discrepancies and <br /> omissions as the new ordinance has been implemented. Some changes are because of <br /> typographical and grammatical errors. Other proposed changes are for matters of consistency <br /> throughout the ordinance. The following changes are proposed additions and deletions to the <br /> ordinance. <br /> 1. All residence districts as well as O-1, B-1 and B-2 will have the following addition in the <br /> conditional use section: "cemetery or cremation garden, provided that all above ground <br /> structures (excluding monuments or grave markers) shall be located at least forty (40) <br /> feet from any side or rear lot line." This was inadvertently left out when the new <br /> ordinance was written. <br /> 2. An addition to the O-1 and B-1 District is "Schools, Commercial: Para-professional" to <br /> the conditional uses section. <br /> 3. A deletion from the B-1 District is "Package liquor store" as a permitted use as it is in <br /> conflict with City Liquor Code. <br /> 4. An addition to the B-2 and M-1 Districts is "Tattoo or body piercing parlor" as a <br /> permitted use,previously it was a conditional use in the M-1 District. <br /> 5. An addition to the B-2 District is "Schools, commercial: Trade and technical" as <br /> conditional uses. <br /> 6. An addition to the B-2 and B-4 Districts is "Para-professional" to the already pertnitted <br /> use of Schools, commercial. <br /> 7. An addition to the M-2 District is "Storage yards" as a conditional use. <br />
