STAFF REPORT Decatur City Plan Commission COMMON NAME: City of Decatur Zoning Ordinance GENERAL INFORMATION Hearing Date January 6, 2003 Calendar No. 04-06 Requested Action Amendments to Zoning Ordinance(Ordinance#3512) Petitioner Dane C. Bragg, Directdr Economic and Urban Development BACKGROUND l. The current City of Decatur Zoning Ordinance was adopted in May of 2002. Since the time of adoption, staff has discovered certain necessary changes, discrepancies and omissions as the new ordinance has been implemented. DESCRIPTION 1. Sections V.B., VI.B., VII.B., VIII.B., IX.B., X.B., XI.C., XII.C. proposed addition of a "cemetery or cremation garden, provided that all structures (excluding monuments or grave markers) shall be located at least forty (40) feet from any side or rear lot line." This was inadvertently left out of conditional uses when the new Ordinance was written. 2. Section V.C.6.b. The m�imum height in feet for building height should read "35" feet instead of three (3) feet. 3. Section IX.C.3. proposed change of the minimum front yard setback from 30 feet to "25" feet. This change is for matters of consistency throughout the ordinance. 4. Section X.B., XI.C., proposed addition of"Schools, Commercial: Para-professional" to the conditional uses sections. 5. Section XI.B.20. proposed removal of the "Package liquor store" as a permitted use as it is in conflict with the City Liquor Code. 6. Section XII.A., XN.A. proposed addition of"Para-professional" to the already permitted use of Schools, commercial. 7. Section XII.A., XVI.A. proposed addition of"Tattoo or body piercing parlor" as a permitted use. 8. Section XII.B. proposed addition of "Schools, commercial: Trade and technical" to conditional uses. 9. Section XII.C.6. proposed change in the number of stories allowed for a building from two (2) to three("3").
