STAFF REPORT <br /> Decatur City Plan Commission <br /> COMMON NAME: City of Decatur Zoning Ordinance <br /> GENERAL INFORMATION <br /> Hearing Date January 6, 2003 <br /> Calendar No. 04-06 <br /> Requested Action Amendments to Zoning Ordinance(Ordinance#3512) <br /> Petitioner Dane C. Bragg, Directdr Economic and Urban Development <br /> BACKGROUND <br /> l. The current City of Decatur Zoning Ordinance was adopted in May of 2002. Since the time <br /> of adoption, staff has discovered certain necessary changes, discrepancies and omissions as <br /> the new ordinance has been implemented. <br /> DESCRIPTION <br /> 1. Sections V.B., VI.B., VII.B., VIII.B., IX.B., X.B., XI.C., XII.C. proposed addition of a <br /> "cemetery or cremation garden, provided that all structures (excluding monuments or grave <br /> markers) shall be located at least forty (40) feet from any side or rear lot line." This was <br /> inadvertently left out of conditional uses when the new Ordinance was written. <br /> 2. Section V.C.6.b. The m�imum height in feet for building height should read "35" feet <br /> instead of three (3) feet. <br /> 3. Section IX.C.3. proposed change of the minimum front yard setback from 30 feet to "25" <br /> feet. This change is for matters of consistency throughout the ordinance. <br /> 4. Section X.B., XI.C., proposed addition of"Schools, Commercial: Para-professional" to the <br /> conditional uses sections. <br /> 5. Section XI.B.20. proposed removal of the "Package liquor store" as a permitted use as it is in <br /> conflict with the City Liquor Code. <br /> 6. Section XII.A., XN.A. proposed addition of"Para-professional" to the already permitted use <br /> of Schools, commercial. <br /> 7. Section XII.A., XVI.A. proposed addition of"Tattoo or body piercing parlor" as a permitted <br /> use. <br /> 8. Section XII.B. proposed addition of "Schools, commercial: Trade and technical" to <br /> conditional uses. <br /> 9. Section XII.C.6. proposed change in the number of stories allowed for a building from two <br /> (2) to three("3"). <br />
