Excerpts from Plan Commission Minutes of August 7, 2003 <br /> Cal. No. 03-37 Petition of ARCHER DANIELS MIDLAND COMPANY <br /> for a Conditional Use Permit for the premises at <br /> 5655 East Rea's Bridge Road to operate a water treatment <br /> facility in an R-1 Residence District. <br /> Ms. Kathy Miller, Senior Planner,was sworn in by Mrs. Althoff. <br /> Ms. Miller presented the recommendation of staff: <br /> An Annexation Agreement between the City and ADM is scheduled for City Council on <br /> August 18, 2003, agreeing to annex territory adjacent to the water treatment facility and <br /> to issue a Conditional Use Permit to operate the water treatment facility in the R-1 <br /> Residential District. ADM plans to develop the property in a manner similar to the <br /> existing facility sometime in the future. The water treatment facility and future additions <br /> are so located and designed to be operated in a manner that the public health, safety and <br /> welfare will be protected. The water treatment facility has not and will not cause <br /> substantial injury to the value of other properties in the neighborhood. The use is <br /> compatible with the Urban Area Land Use Plan. <br /> Staff is of the opinion that the best interests of the City of Decatur would be served by <br /> approving the Conditional Use Permit for the water treatment facility in the proposed <br /> location. Staff recommends approval of the petition with the following condition: <br /> a. ADM will screen the site with a landscaped berm and a grass buffer yard <br /> (minimum of fifteen(15)feet in width will be provided around the site and <br /> b. A site plan will be submitted and approved by the Economic and Urban <br /> Development Department and the Engineering and Infrastructure Department. <br /> The Zoning Ordinance of the City of Decatur requires that conditional use requests be <br /> submitted to the Plan Commission for public hearing, study and report concerning the <br /> effect of the proposed use on the comprehensive plan and compliance with ordinance <br /> standards. A motion to forward the request of Cal. No. 03-37 to the City Council with a <br /> recommendation of approval is suggested. <br /> Mr. Nordholm had a question as to whether the buffer was 15' wide or high. <br /> Ms. Miller stated that it was wide. <br /> Mr. Nordholm stated that his concern with this petition was that there was a house to the <br /> west that was owned by ADM and that there were two (2) other houses that looked to be <br />
